1 3 #1. Page 8, by inserting after line 17 the
1 4 following:
1 5 "Sec. . Section 97B.42A, Code Supplement 2003,
1 6 is amended by adding the following new subsection:
1 7 NEW SUBSECTION. 6. A person who is employed in a
1 8 position as an employee as defined in section 97B.1A,
1 9 subsection 8, paragraph "a", subparagraph (7), on July
1 10 1, 2004, and who has elected out of coverage under
1 11 this chapter prior to that date, shall not become a
1 12 member under the retirement system on July 1, 2004,
1 13 unless, on or before August 31, 2004, the person files
1 14 an application with appropriate documentation to elect
1 15 coverage under this chapter. If a person elects
1 16 coverage under this chapter, the period of time from
1 17 July 1, 2004, until the date the person's election of
1 18 coverage is effective shall not constitute service for
1 19 purposes of coverage under this chapter. A decision
1 20 to elect coverage under this chapter under this
1 21 subsection is irrevocable upon approval from the
1 22 system.
1 23 A person who becomes a member of the Iowa public
1 24 employees' retirement system pursuant to this
1 25 subsection, and who has one or more years of covered
1 26 wages, may purchase credit, pursuant to section
1 27 97B.80C, for one or more quarters of service prior to
1 28 July 1, 2004, in which the person was employed in a
1 29 position as described by section 97B.1A, subsection 8,
1 30 paragraph "a", subparagraph (7), but was not a member
1 31 of the retirement system."
