  1  1    Amend Senate File 2176 as follows:
  1  2    #1.  Page 1, line 33, by inserting after the word
  1  3 "ANTIBULLYING" the following:  "AND ANTIHARASSMENT".
  1  4    #2.  By striking page 1, line 35, through page 2,
  1  5 line 1, and inserting the following:  "prohibiting
  1  6 bullying and harassment of all students based on any
  1  7 real or perceived characteristic, including, but not
  1  8 limited to, age, color, creed, national origin, race,
  1  9 religion, marital status, sex, sexual orientation,
  1 10 gender identity, physical attributes, physical or
  1 11 mental ability or disability, ancestry, political
  1 12 party preference, socioeconomic status, or familial
  1 13 status.  The policy shall be developed with local
  1 14 input from".
  1 15    #3.  Page 2, by striking lines 9 through 19 and
  1 16 inserting the following:
  1 17    "a.  A definition of bullying and harassment which
  1 18 shall be construed to mean the same and defined to
  1 19 mean any conduct toward a student that is based on any
  1 20 real or perceived characteristic, including, but not
  1 21 limited to, age, color, creed, national origin, race,
  1 22 religion, marital status, sex, sexual orientation,
  1 23 gender identity, physical attributes, physical or
  1 24 mental ability or disability, ancestry, political
  1 25 party preference, socioeconomic status, or familial
  1 26 status, and that creates an objectively hostile school
  1 27 environment which meets any of the following
  1 28 conditions:
  1 29    (1)  Places the student in reasonable fear of harm
  1 30 to the student's person or property.
  1 31    (2)  Has a substantially detrimental effect on the
  1 32 student's physical or mental health.
  1 33    (3)  Has the effect of substantially interfering
  1 34 with a student's academic performance.
  1 35    (4)  Has the effect of substantially interfering
  1 36 with the student's ability to participate in or
  1 37 benefit from the services, activities, or privileges
  1 38 provided by a school.
  1 39    b.  Effective prevention strategies and
  1 40 professional development for teachers and
  1 41 administrators.
  1 42    c.  Monitoring and evaluation of the policy's
  1 43 effectiveness and inclusion in the comprehensive
  1 44 school improvement plan filed with the department of
  1 45 education in accordance with section 256.7, subsection
  1 46 21.
  1 47    d.  Procedures for receiving and responding to
  1 48 complaints.
  1 49    e.  Consequences and appropriate remedial action
  1 50 for violation of the policy, taking into account the
  2  1 pattern and severity of particular bullying and
  2  2 harassing behavior.
  2  3    f.  Public notice of the policy.
  2  4    g.  Prohibition of reprisals or retaliation against
  2  5 any person who reports bullying or harassing
  2  6 behavior."
  2  7    #4.  Title page, line 1, by inserting after the
  2  8 word "bullying" the following:  "and harassment".
  2  9    #5.  Title page, line 2, by inserting after the
  2 10 word "antibullying" the following:  "and
  2 11 antiharassment".
