PAG LIN 1 1 Amend the House amendment, S-3324, to Senate File 1 2 445, as amended, passed, and reprinted by the Senate, 1 3 as follows: 1 4 #1. Page 1, by inserting after line 2 the 1 5 following: 1 6 "# . Page 1, by inserting before line 1 the 1 7 following: 1 8 "Section 1. NEW SECTION. 298.2A PHYSICAL PLANT 1 9 AND EQUIPMENT LEVY STATE FUND DISTRIBUTION. 1 10 1. A physical plant and equipment levy state fund 1 11 is created as a separate and distinct fund in the 1 12 state treasury under the control of the department of 1 13 education. Any moneys disbursed from the fund shall 1 14 be used as provided in section 298.3. 1 15 2. For the school budget year beginning July 1, 1 16 2004, and for each succeeding budget year, the county 1 17 treasurer shall remit to the department of education 1 18 for deposit into the physical plant and equipment levy 1 19 state fund the property tax revenues received from the 1 20 collection during the school budget year of the 1 21 regular physical plant and equipment levy. 1 22 3. The amount deposited in the physical plant and 1 23 equipment levy state fund in a budget year shall be 1 24 distributed as follows: 1 25 a. Each school district that has imposed the 1 26 regular physical plant and equipment levy shall 1 27 receive an amount per pupil equal to the amount in the 1 28 state fund divided by the combined actual enrollment 1 29 of all school districts that impose such levy. The 1 30 actual enrollment figures for each such school 1 31 district reported by October 1 to the department of 1 32 education pursuant to section 257.6, subsection 1, 1 33 shall be used to determine the combined actual 1 34 enrollment. 1 35 b. Notwithstanding the computation of the amount 1 36 per pupil in paragraph "a", if a school district has 1 37 incurred indebtedness or issued bonds which were 1 38 incurred or issued prior to April 1, 2003, and that 1 39 certifies that the amount to be received pursuant to 1 40 paragraph "a" plus any amount to be received from the 1 41 voter-approved physical plant and equipment levy is 1 42 insufficient to pay principal and interest on the 1 43 indebtedness or bonds, the school district may certify 1 44 such fact to the department of education and the 1 45 department shall provide the amount needed to pay 1 46 principal and interest but not to exceed the amount 1 47 collected from the school district's regular physical 1 48 plant and equipment levy. The amounts paid under this 1 49 subject to all school districts shall be paid from the 1 50 state fund prior to determining the actual per pupil 2 1 amount to be distributed to each district. 2 2 c. Distributions to school districts shall be made 2 3 approximately one-half by September 15 and the 2 4 remainder by March 15 of the budget year. 2 5 d. This section does not apply to the collection 2 6 and distribution of any voter-approved physical plant 2 7 and equipment levy."" 2 8 #2.
