1 1 Amend Senate File 445 as follows:
1 2 #1. Page 10, by striking lines 6 through 24 and
1 3 inserting the following:
1 4 "6. A school district shall not expend the
1 5 supplemental school infrastructure amount received for
1 6 new construction or for payments for bonds issued for
1 7 new construction against the supplemental school
1 8 infrastructure amount without first getting an
1 9 advisory opinion from the department of education as
1 10 to the need for such expenditure. However, an
1 11 advisory opinion is not required for the payment of
1 12 outstanding bonds issued for new construction pursuant
1 13 to section 296.1, before April 1, 2003. An advisory
1 14 opinion is also not required for repairing
1 15 schoolhouses or buildings, equipment, technology, or
1 16 transportation equipment for transporting students as
1 17 provided in section 298.3, or for construction
1 18 necessary for compliance with the federal Americans
1 19 With Disabilities Act pursuant to 42 U.S.C. } 12101-
1 20 12117. In preparing an advisory opinion, the
1 21 department shall consider all of the following:"
