1 1 Amend Senate File 445 as follows:
1 2 #1. By striking page 5, line 34, through page 6,
1 3 line 4 and inserting following:
1 4 "e. The amount of tax receipts credited to the
1 5 account within the secure an advanced vision for
1 6 education fund maintained in the name of a school
1 7 district shall be distributed to that school district
1 8 as provided in paragraphs "a", "b", and "c". Any
1 9 additional moneys available to the school district
1 10 from the fund shall be determined and distributed as a
1 11 supplemental school infrastructure amount as provided
1 12 in section 422E.3A, subsection 3."
1 13 #2. Page 6, line 25, by inserting after the word
1 14 "fund." the following: "Appropriations made to the
1 15 fund shall be credited to a separate appropriations
1 16 account."
1 17 #3. By striking page 6, line 28 through page 10,
1 18 line 5 and inserting the following:
1 19 "2. a. For purposes of the distributions in
1 20 subsection 3, the department of education, in
1 21 consultation with the departments of management and
1 22 revenue and finance, shall compute by June 1 preceding
1 23 each budget year the infrastructure tax capacity,
1 24 statewide infrastructure tax capacity, and
1 25 infrastructure tax capacity inequity for each school
1 26 district located in whole or in part in a county that
1 27 has imposed the local sales and services tax for
1 28 school infrastructure purposes under this chapter.
1 29 (1) "Actual enrollment" for a school district
1 30 means the actual enrollment as reported by October 1
1 31 to the department of management by the department of
1 32 education pursuant to section 257.6, subsection 1.
1 33 (2) "Infrastructure tax capacity" means for a
1 34 school district the estimated amount of revenues that
1 35 a school district receives or would receive if the
1 36 regular physical plant and equipment levy of thirty-
1 37 three cents per thousand dollars is imposed divided by
1 38 the school district's actual enrollment.
1 39 (3) "Infrastructure tax capacity inequity" means
1 40 the amount that a school district's infrastructure tax
1 41 capacity is less than the statewide infrastructure tax
1 42 capacity. If a school district's infrastructure tax
1 43 capacity exceeds the statewide infrastructure tax
1 44 capacity, the school district does not have an
1 45 inequity.
1 46 (4) "Statewide infrastructure tax capacity" means
1 47 the amount determined by estimating the total revenues
1 48 that would be generated by a regular physical plant
1 49 and equipment levy of thirty-three cents per thousand
1 50 dollars if imposed by all the school districts during
2 1 the budget year and dividing this estimated revenue
2 2 amount by the sum of the combined actual enrollment
2 3 for all school districts.
2 4 3. The appropriations credited in a fiscal year to
2 5 the appropriations account of the secure an advanced
2 6 vision for education fund shall be distributed as a
2 7 supplemental school infrastructure amount as follows:
2 8 a. The department of education shall compute the
2 9 infrastructure tax capacity inequity of each school
2 10 district located in whole or in part in a county that
2 11 has imposed the tax under this chapter.
2 12 b. The department of revenue and finance, in
2 13 conjunction with the department of education, shall
2 14 distribute to the extent sufficient funds are
2 15 available a supplemental school infrastructure amount
2 16 to each school district that has an infrastructure tax
2 17 capacity inequity. The amount of the supplemental
2 18 school infrastructure amount distributed shall be an
2 19 amount equal to the school district's infrastructure
2 20 tax capacity inequity. If sufficient funds are not
2 21 available, the director of revenue and finance shall
2 22 distribute to the school district with the highest
2 23 infrastructure tax capacity inequity an amount equal
2 24 to such inequity. Any additional funds shall then be
2 25 distributed to the school district with the next
2 26 highest inequity. Any additional funds will then be
2 27 distributed to the next school district in descending
2 28 order of inequity until the funds have all been
2 29 distributed.
2 30 4. Moneys received by a school district as a
2 31 supplemental school infrastructure amount shall be
2 32 used solely for school infrastructure purposes and
2 33 shall not be used to reduce any property tax levy."

2 35 figure "2, paragraph "b"" and inserting the following:
