  1  1    Amend Senate File 445 as follows:
  1  2    #1.  By striking page 5, line 34, through page 6,
  1  3 line 4 and inserting following:
  1  4    "e.  The amount of tax receipts credited to the
  1  5 account within the secure an advanced vision for
  1  6 education fund maintained in the name of a school
  1  7 district shall be distributed to that school district
  1  8 as provided in paragraphs "a", "b", and "c".  Any
  1  9 additional moneys available to the school district
  1 10 from the fund shall be determined and distributed as a
  1 11 supplemental school infrastructure amount as provided
  1 12 in section 422E.3A, subsection 3."
  1 13    #2.  Page 6, line 25, by inserting after the word
  1 14 "fund." the following:  "Appropriations made to the
  1 15 fund shall be credited to a separate appropriations
  1 16 account."
  1 17    #3.  By striking page 6, line 28 through page 10,
  1 18 line 5 and inserting the following:
  1 19    "2.  a.  For purposes of the distributions in
  1 20 subsection 3, the department of education, in
  1 21 consultation with the departments of management and
  1 22 revenue and finance, shall compute by June 1 preceding
  1 23 each budget year the uniform levy capacity, statewide
  1 24 uniform levy capacity, and property tax capacity
  1 25 inequity for each school district located in whole or
  1 26 in part in a county that has imposed the local sales
  1 27 and services tax for school infrastructure purposes
  1 28 under this chapter.
  1 29    (1)  "Actual enrollment" for a school district
  1 30 means the actual enrollment as reported by October 1
  1 31 to the department of management by the department of
  1 32 education pursuant to section 257.6, subsection 1.
  1 33    (2)  "Property tax capacity inequity" means the
  1 34 amount that a school district's uniform levy capacity
  1 35 is less than the statewide uniform levy capacity.  If
  1 36 a school district's uniform levy capacity exceeds the
  1 37 statewide uniform levy capacity, the school district
  1 38 does not have an inequity.
  1 39    (3)  "Statewide uniform levy capacity" means the
  1 40 total amount raised by all school districts in the
  1 41 state by the uniform levy of five dollars and forty
  1 42 cents per thousand dollars of assessed valuation
  1 43 divided by the combined actual enrollment of all
  1 44 school districts in the state.
  1 45    (4)  "Uniform levy capacity" means for a school
  1 46 district the amount raised by the school district's
  1 47 uniform levy of five dollars and forty cents per
  1 48 thousand dollars of assessed valuation divided by the
  1 49 actual enrollment of the school district.
  1 50    3.  The appropriations credited in a fiscal year to
  2  1 the appropriations account of the secure an advanced
  2  2 vision for education fund shall be distributed as a
  2  3 supplemental school infrastructure amount as follows:
  2  4    a.  The department of education shall compute the
  2  5 property tax capacity inequity of each school district
  2  6 located in whole or in part in a county that has
  2  7 imposed the tax under this chapter.
  2  8    b.  The department of revenue and finance, in
  2  9 conjunction with the department of education, shall
  2 10 distribute to the extent sufficient funds are
  2 11 available a supplemental school infrastructure amount
  2 12 to each school district that has a property tax
  2 13 capacity inequity.  The amount of the supplemental
  2 14 school infrastructure amount distributed shall be an
  2 15 amount equal to the school district's property tax
  2 16 capacity inequity.  If sufficient funds are not
  2 17 available, the director of revenue and finance shall
  2 18 distribute to the school district with the highest
  2 19 property tax capacity inequity an amount equal to such
  2 20 inequity.  Any additional funds shall then be
  2 21 distributed to the school district with the next
  2 22 highest inequity.  Any additional funds will then be
  2 23 distributed to the next school district in descending
  2 24 order of inequity until the funds have all been
  2 25 distributed.
  2 26    4.  Moneys received by a school district as a
  2 27 supplemental school infrastructure amount shall be
  2 28 used solely for school infrastructure purposes and
  2 29 shall not be used to reduce any property tax levy."

  2 31 figure "2, paragraph "b"" and inserting the following:
