PROGRAM PLAN, FUNDING, AND OPERATION. 1 34 The department of natural resources is not required to 1 35 begin operation of the off-highway vehicle program 1 36 until the Iowa association of four wheel drive clubs 1 37 develops and presents for the department's approval a 1 38 revenue-neutral five-year plan for operation of the 1 39 program. The plan shall include an analysis of the 1 40 number of off-highway vehicles expected to be 1 41 registered prior to the establishment of an off- 1 42 highway vehicle recreation area and the number of 1 43 registrations expected after the establishment of such 1 44 a facility. The plan shall also include optimum 1 45 locations for an off-highway vehicle recreation area, 1 46 estimated costs, if any, for maintenance of the area, 1 47 and any other issues the department and the 1 48 association deem to be of importance in the planning 1 49 process. The plan shall be completed and available 1 50 for approval by the department no later than January 2 1 1, 2004. 2 2 The department shall not begin registration of off- 2 3 highway vehicles until a five-year plan has been 2 4 developed and approved. Notwithstanding the 2 5 provisions of chapter 321N, as enacted in this Act, 2 6 fees collected by the department from the registration 2 7 of off-highway vehicles, as required in this Act, 2 8 shall be deposited in the off-highway vehicle fund 2 9 created in section 321N.5 and allowed to accumulate 2 10 without expenditure, other than for the department's 2 11 expenses for administration of the fund, until the 2 12 department begins operation of the state's off-highway 2 13 vehicle program. When revenues in the fund are 2 14 sufficient to cover the operational costs of the off- 2 15 highway vehicle program, the department shall begin 2 16 operation of the program. For purposes of this 2 17 section, "operation of the program" includes, but is 2 18 not limited to, the purchasing of land for use by off- 2 19 highway vehicles, initiating a safety certificate 2 20 program, and employing part-time or full-time 2 21 employees to administer the off-highway program." 2 22 #11.
