PAG LIN 1 1 Amend Senate File 388 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. NEW SECTION. 7.23 TECHNOLOGY 1 5 TRANSFER ADVISOR. 1 6 Two technology transfer advisors shall be appointed 1 7 by the governor, serve at the pleasure of the 1 8 governor, and be located at offices at the university 1 9 of Iowa and Iowa state university of science and 1 10 technology. A technology transfer advisor is not a 1 11 state agency and is not subject to chapter 17A. A 1 12 technology transfer advisor shall do all of the 1 13 following: 1 14 1. Facilitate the transfer of technology developed 1 15 at universities under the control of the state board 1 16 of regents, community colleges, and private colleges 1 17 and universities. 1 18 2. Coordinate the technology transfer activities 1 19 at each of the public and private universities to 1 20 encourage the implementation of best practices in 1 21 technology transfer, establish measures of 1 22 performance, and design programs of continuous quality 1 23 improvement for each technology transfer office. 1 24 3. Establish technology transfer goals for the 1 25 state. 1 26 4. Provide technical assistance to Iowa-based 1 27 entrepreneurs associated with or unrelated to the 1 28 universities under the control of the state board of 1 29 regents regarding technology transfer-related issues. 1 30 The technical assistance shall include assistance in 1 31 the areas of patents and licensing, business 1 32 development and management, finance, production, 1 33 sales, and marketing. 1 34 5. Receive the technology transfer-related report 1 35 submitted by the state board of regents pursuant to 1 36 section 262.9, subsection 31. 1 37 6. To ensure economic growth, serve as a 1 38 coordinator between Iowa-based businesses and 1 39 businesses intending to locate in Iowa. 1 40 Sec. . Section 15.108, Code 2003, is amended by 1 41 adding the following new subsection: 1 42 NEW SUBSECTION. 12. TECHNOLOGY TRANSFER ADVISORS. 1 43 The department shall cooperate with and provide 1 44 staffing support to the technology transfer advisors 1 45 appointed pursuant to section 7.23. 1 46 Sec. . Section 262.9, Code 2003, is amended by 1 47 adding the following new subsections: 1 48 NEW SUBSECTION. 29. Actively encourage and 1 49 promote the transfer of technology and research at 1 50 universities under the control of the board to 2 1 commercial application, including the start-up of 2 2 business entities. 2 3 NEW SUBSECTION. 30. Give preference and technical 2 4 support to those faculty members and staff members 2 5 desiring to obtain licenses for intellectual property 2 6 rights created in whole or in part by the faculty 2 7 member or staff member. However, such preference 2 8 shall not be construed to be a right accruing to that 2 9 faculty member or staff member. 2 10 NEW SUBSECTION. 31. By January 15 of each year, 2 11 submit a report to the governor, through the 2 12 technology transfer advisors, and the general assembly 2 13 containing information from the previous calendar year 2 14 regarding all of the following: 2 15 a. Patents secured or applied for by each 2 16 university under the control of the board delineated 2 17 by university and by faculty member and staff member 2 18 responsible for the research or activity that resulted 2 19 in the patent. In the initial report filed by January 2 20 15, 2004, the board shall include an inventory of 2 21 patent portfolios with details concerning which 2 22 patents are creating financial benefit and the amount 2 23 of financial benefit and which patents are not 2 24 creating financial benefit and the amount invested in 2 25 those patents. 2 26 b. Research grants secured by each university 2 27 under the control of the board from both public and 2 28 private sources delineated by university and by 2 29 faculty member and staff member. The board shall also 2 30 include the same information for grant applications 2 31 that are denied. 2 32 c. The number of faculty members and staff members 2 33 at each university under the control of the board 2 34 involved in a start-up company. 2 35 d. The number of grant applications for research 2 36 received by each university under the control of the 2 37 board for start-up companies, the number of 2 38 applications approved, and the number of applications 2 39 denied. 2 40 e. The number of agreements entered into by 2 41 faculty members and staff members at each university 2 42 under the control of the board with foundations 2 43 affiliated with the universities relating to business 2 44 start-ups. 2 45 f. An accounting of the financial gain received by 2 46 each university under the control of the board 2 47 relating to patents sold, royalties received, 2 48 licensing fees, and any other remuneration received by 2 49 the university related to technology transfer. 2 50 g. The number of professional employees at each 3 1 university under the control of the board who assist 3 2 in the transfer of technology and research to 3 3 commercial application. 3 4 Sec. .
