1 2 #1. Page 1, by inserting after line 9, the
1 3 following:
1 4 "Sec. . Section 321.493, subsection 1,
1 5 paragraph a, Code 2003, is amended to read as follows:
1 6 a. Subject to paragraph "b", in all cases where
1 7 damage is done by any motor vehicle by reason of
1 8 negligence of the driver, and driven with the consent
1 9 of the owner, the owner of the motor vehicle shall be
1 10 liable for such damage. For purposes of this
1 11 subsection, "owner" means the person to whom the
1 12 certificate of title for the vehicle has been issued
1 13 or assigned or to whom a manufacturer's or importer's
1 14 certificate of origin for the vehicle has been
1 15 delivered or assigned. However, if the vehicle is
1 16 leased or rented, "owner" means the person to whom the
1 17 vehicle is leased or rented, not the person to whom
1 18 the certificate of title for the vehicle has been
1 19 issued or assigned or to whom the manufacturer's or
1 20 importer's certificate of origin for the vehicle has
1 21 been delivered or assigned. For purposes of this
1 22 subsection, "leased" means the transfer of the
1 23 possession or right to possession of a vehicle to a
1 24 lessee for a valuable consideration for a continuous
1 25 period of twelve months or more, pursuant to a written
1 26 agreement. For purposes of this subsection, "rented"
1 27 means the temporary transfer of the possession or
1 28 right to possession of a vehicle to a renter as
1 29 defined in section 522A.2."
