  1  1    Amend Senate File 297 as follows:
  1  2    #1.  Page 37, lines 11 and 12, by striking the
  1  3 words "fees collected pursuant to section 321I.4 and".
  1  4    #2.  Page 37, line 20, by inserting after the word
  1  5 "commission." the following:  "All-terrain vehicle
  1  6 fees may be used for the establishment, maintenance,
  1  7 and operation of all-terrain vehicle recreational
  1  8 riding areas through the awarding of grants
  1  9 administered by the department.  All-terrain vehicle
  1 10 recreational riding areas established, maintained, or
  1 11 operated by the use of such grants shall not be
  1 12 operated for profit."
  1 13    #3.  Page 47, by inserting before line 1, the
  1 14 following:
  1 15    "Sec.    .  NEW SECTION.  321I.23A  RECREATIONAL
  1 16 RIDING AREA – LIMITATION OF LIABILITY OF LANDOWNERS.
  1 17    A public or private owner of land on which an all-
  1 18 terrain vehicle recreational riding area is
  1 19 established, maintained, or operated and the public or
  1 20 private owner of property adjoining such land owe no
  1 21 duty of care to keep the land and the adjoining land
  1 22 safe for entry or use by persons operating an all-
  1 23 terrain vehicle or other recreational vehicle, or to
  1 24 give any warning of a dangerous condition, use,
  1 25 structure, or activity on such premises to persons
  1 26 entering for such purposes.  A lessee or other agent
  1 27 of the owner and any prior owners of the land and
  1 28 adjoining land shall have no greater duty of care than
  1 29 the current owner or current adjoining owner."
