  1  1    Amend House File 65, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 2, by inserting after line 4 the
  1  4 following:
  1  5    "Sec.    .  Section 321J.2, subsection 3, paragraph
  1  6 a, subparagraph (1), Code 2003, is amended to read as
  1  7 follows:
  1  8    (1)  If the defendant's alcohol concentration
  1  9 established by the results of an analysis of a
  1 10 specimen of the defendant's blood, breath, or urine
  1 11 withdrawn in accordance with this chapter exceeds .15,
  1 12 regardless of whether or not the alcohol concentration
  1 13 indicated by the chemical test minus the established
  1 14 margin of error inherent in the device or method used
  1 15 to conduct the test equals an alcohol concentration of
  1 16 .15 or more.  This subparagraph shall not prohibit the
  1 17 court from deferring judgment for a defendant
  1 18 convicted of a first offense under subsection 2,
  1 19 paragraph "a"."
  1 20    #2.  Page 6, by inserting after line 22 the
  1 21 following:
  1 22    "Sec.    .  Section 907.3, subsection 1, paragraph
  1 23 g, subparagraph (1), Code 2003, is amended to read as
  1 24 follows:
  1 25    (1)  If the defendant's alcohol concentration
  1 26 established by the results of an analysis of a
  1 27 specimen of the defendant's blood, breath, or urine
  1 28 withdrawn in accordance with chapter 321J exceeds .15,
  1 29 regardless of whether or not the alcohol concentration
  1 30 indicated by the chemical test minus the established
  1 31 margin of error inherent in the device or method used
  1 32 to conduct the test equals an alcohol concentration of
  1 33 .15 or more.  This subparagraph shall not prohibit the
  1 34 court from deferring judgment for a defendant
