  1  1    Section 1.  Section 306.4, subsection 3, Code Supplement
  1  2 2003, is amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  d.  If, within the two years immediately
  1  4 preceding a transfer, a city has made repairs or improvements
  1  5 to a road for which jurisdiction and control transfers to a
  1  6 county pursuant to paragraph "a" or "b", any debt incurred by
  1  7 the city for such road repairs or improvements that remains
  1  8 outstanding, but not delinquent, at the time of the transfer
  1  9 shall be assumed by the county.
  1 10    Sec. 2.  TRANSFER OF JURISDICTION FUND APPORTIONMENTS TO
  1 11 CERTAIN COUNTIES AND CITIES.
  1 12    1.  Notwithstanding section 313.4, subsection 6, if a city
  1 13 or county that assumed jurisdiction of a road identified in
  1 14 the report referred to in section 306.8A elected not to enter
  1 15 into an agreement with the state department of transportation
  1 16 on or before December 31, 2002, to assume jurisdiction of the
  1 17 road, the apportionment to the city or county from the
  1 18 transfer of jurisdiction fund under section 313.4, subsection
  1 19 6, paragraph "b", shall not be less than the amount offered by
  1 20 the state department of transportation in the agreement under
  1 21 consideration on or before December 31, 2002.
  1 22    2.  The amount of moneys transferred from the primary road
  1 23 fund to the transfer of jurisdiction fund for each fiscal year
  1 24 of the fiscal period beginning July 1, 2004, and ending June
  1 25 30, 2013, pursuant to section 313.4, subsection 6, paragraph
  1 26 "a", shall be increased by the amount necessary to adjust the
  1 27 total apportionment to cities or counties described in
  1 28 subsection 1 to the amount offered by the state department of
  1 29 transportation on or before December 31, 2002.  
  1 30                           EXPLANATION
  1 31    This bill requires that when jurisdiction and control of a
  1 32 road transfers from a city with a population of less than 500
  1 33 to a county by operation of law, any nondelinquent debt
  1 34 incurred by the city within the preceding two years for
  1 35 repairs or improvements to the road shall be assumed by the
  2  1 county.
  2  2    The bill also provides that the amount of the apportionment
  2  3 from the transfer of jurisdiction fund to a city or county
  2  4 that assumed jurisdiction of a road pursuant to 2003 Acts,
  2  5 chapter 144, shall not be less than the amount the city or
  2  6 county would have received pursuant to an agreement offered by
  2  7 the state department of transportation on or before December
  2  8 31, 2002.  The bill directs that the amount of moneys
  2  9 transferred from the primary road fund to the transfer of
  2 10 jurisdiction fund for each fiscal year of the fiscal period
  2 11 beginning July 1, 2004, and ending June 30, 2013, shall be
  2 12 increased to make the necessary adjustment to the affected
  2 13 counties and cities.
