  1  1    Section 1.  NEW SECTION.  15A.11  IOWA PRODUCTS AND
  1  2 SERVICES.
  1  3    A private person shall use a product produced in this state
  1  4 or a service provided by a service provider located in this
  1  5 state and subject to the regulations of this state when the
  1  6 product or service is found in marketable quantities in this
  1  7 state and is of a quality reasonably suited to the purpose
  1  8 intended and can be secured without additional cost over
  1  9 foreign products or services or products or services produced
  1 10 or provided by producers or providers located in other states.
  1 11    Sec. 2.  Section 73.1, Code 2003, is amended to read as
  1 12 follows:
  1 13    73.1  PREFERENCE – CONDITIONS.
  1 14    Every commission, board, committee, officer or other
  1 15 governing body of the state, or of any county, township,
  1 16 school district or city, and every person acting as
  1 17 contracting or purchasing agent for any such commission,
  1 18 board, committee, officer or other governing body shall use
  1 19 only those products and provisions grown and coal produced
  1 20 within the state of Iowa and those services provided by
  1 21 service providers located within the state of Iowa, when they
  1 22 are found in marketable quantities in the state and are of a
  1 23 quality reasonably suited to the purpose intended, and can be
  1 24 secured without additional cost over foreign products and
  1 25 services or products of and services provided by producers and
  1 26 providers in other states.  This section shall apply to
  1 27 horticultural products grown in this state even if the
  1 28 products are not in the stage of processing that the agency
  1 29 usually purchases the product.  However, this section does not
  1 30 apply to a school district purchasing food while the school
  1 31 district is participating in the federal school lunch program.
  1 32    Sec. 3.  Section 73.2, subsection 1, Code Supplement 2003,
  1 33 is amended to read as follows:
  1 34    1.  All requests hereafter made for bids and proposals for
  1 35 materials, products, supplies, provisions, and other needed
  2  1 articles, and services to be purchased at public expense,
  2  2 shall be made in general terms and by general specifications
  2  3 and not by brand, trade name, or other individual mark.  All
  2  4 such requests and bids shall contain a paragraph in easily
  2  5 legible print, reading as follows:
  2  6    By virtue of statutory authority, a preference will be
  2  7 given to services provided by service providers located within
  2  8 the state of Iowa and products and provisions grown and coal
  2  9 produced within the state of Iowa.  
  2 10                           EXPLANATION
  2 11    This bill relates to state and private preferences for
  2 12 products from Iowa producers and services from Iowa service
  2 13 providers.
  2 14    The bill provides that a private person shall use a product
  2 15 produced in this state or a service provided by a service
  2 16 provider located in this state and subject to the regulations
  2 17 of this state when the product or service is found in
  2 18 marketable quantities in this state and is of a quality
  2 19 reasonably suited to the purpose intended and can be secured
  2 20 without additional cost over foreign products or services or
  2 21 products or services produced or provided by producers or
  2 22 providers located in other states.
  2 23    The bill provides governmental preferences for services
  2 24 provided by service providers located within the state of Iowa
  2 25 when the services are found in marketable quantities in the
  2 26 state and are of a quality reasonably suited to the purpose
  2 27 intended, and can be secured without additional cost over
  2 28 foreign services or services provided by providers in other
  2 29 states.  The bill makes conforming amendments to the
  2 30 advertisements for governmental services to be purchased at
  2 31 public expense.
