1 1 Section 1. Section 8A.321, subsection 8, Code Supplement
1 2 2003, is amended to read as follows:
1 3 8. With the authorization of a constitutional majority of
1 4 each house of the general assembly and approval by the
1 5 governor, dispose of real property belonging to the state and
1 6 its state agencies upon terms, conditions, and consideration
1 7 as the director may recommend. The department shall be
1 8 reimbursed for administrative costs incurred relating to a
1 9 sale under this subsection and shall retain from the proceeds
1 10 of the sale an amount equal to five percent of the total
1 11 proceeds from the sale. If real property subject to sale
1 12 under this subsection has been purchased or acquired from
1 13 appropriated funds, the proceeds of the sale, less the amount
1 14 retained by the department for administrative costs as
1 15 provided in this subsection, shall be deposited with the
1 16 treasurer of state and credited to the general fund of the
1 17 state or other fund from which appropriated. There is
1 18 appropriated from that same fund, with the prior approval of
1 19 the executive council and in cooperation with the director, a
1 20 sum equal to the proceeds so deposited and credited to the
1 21 state agency to which the disposed real property belonged or
1 22 by which it was used, for purposes of the state agency.
1 23 EXPLANATION
1 24 This bill amends Code section 8A.321, subsection 8, to
1 25 allow the department of administrative services to retain 5
1 26 percent of the proceeds of a sale of real property belonging
1 27 to the state as reimbursement for administrative costs
1 28 incurred relating to the sale.
