1 1 Section 1. Section 232.58, subsection 1, paragraph a, Code
1 2 2003, is amended to read as follows:
1 3 a. For an order for which the court has not waived
1 4 reasonable efforts requirements, the permanency hearing shall
1 5 be subject to one of the following time frames:
1 6 (1) For a child who is less than four years of age at the
1 7 time of removal, the hearing shall be held within six months
1 8 of the date the child was removed from the home. However, if
1 9 the child would become four years of age or older before the
1 10 latest date the hearing could be held, the hearing shall be
1 11 subject to the time frame specified in subparagraph (2).
1 12 (2) For a child who is four years of age or older at the
1 13 time of the removal, the hearing shall be held within twelve
1 14 months of the date the child was removed from the home.
1 15 Sec. 2. Section 232.104, subsection 1, paragraph a,
1 16 subparagraph (1), Code 2003, is amended to read as follows:
1 17 (1) For a temporary removal order entered under section
1 18 232.78, 232.95, or 232.96, for a child who was removed without
1 19 a court order under section 232.79, or for an order entered
1 20 under section 232.102, for which the court has not waived
1 21 reasonable efforts requirements, the permanency hearing shall
1 22 be subject to one of the following time frames:
1 23 (a) For a child who is less than four years of age at the
1 24 time of removal, the hearing shall be held within six months
1 25 of the date the child was removed from the home. However, if
1 26 the child would become four years of age or older before the
1 27 latest date the hearing could be held, the hearing shall be
1 28 subject to the time frame specified in subparagraph
1 29 subdivision (b).
1 30 (b) For a child who is four years of age or older at the
1 31 time of the removal, the hearing shall be held within twelve
1 32 months of the date the child was removed from the home.
1 33 Sec. 3. EFFECTIVE DATE. This Act, being deemed of
1 34 immediate importance, takes effect upon enactment.
1 35 EXPLANATION
2 1 This bill revises the time period required for holding the
2 2 initial permanency hearing for a child who is subject to an
2 3 order for out-of-home placement, based upon the child's age.
2 4 Under current law, the initial permanency hearing for a
2 5 child who is subject to an order for out-of-home placement
2 6 following a delinquency or child in need of assistance
2 7 adjudication must be held within 12 months of the child's
2 8 removal. The bill provides that if the child is less than
2 9 four years of age, the hearing must be held with six months of
2 10 the date of removal. However, if the child would become four
2 11 years of age before the latest date the hearing could be held,
2 12 the hearing must be held within 12 months of the date of
2 13 removal.
2 14 The bill takes effect upon enactment.
