  1  1    Section 1.  Section 89.2, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  0A.  "ASME code cases" means additions and
  1  4 revisions made by the American society of mechanical engineers
  1  5 (ASME) to the ASME boiler and pressure vessel code.
  1  6    Sec. 2.  Section 89.3, subsection 5, Code 2003, is amended
  1  7 to read as follows:
  1  8    5.  The commissioner may inspect boilers and tanks and
  1  9 other equipment stamped with the American Society society of
  1 10 Mechanical Engineers mechanical engineers code symbol for
  1 11 other than steam pressure, manufactured in Iowa, when
  1 12 requested by the manufacturer.  However, the commissioner
  1 13 shall not cause modification, alteration, or repair of a
  1 14 boiler that will void the boiler's certification by the
  1 15 American society of mechanical engineers and the gas appliance
  1 16 manufacturers association of America.
  1 17    Sec. 3.  Section 89.5, subsection 1, Code 2003, is amended
  1 18 to read as follows:
  1 19    1.  The commissioner may prescribe rules under the
  1 20 provisions of chapter 17A, for the purpose of carrying out the
  1 21 provisions of this chapter, including rules for the methods of
  1 22 testing equipment and construction and installation of new
  1 23 equipment covered by this chapter, and the rules shall, as
  1 24 nearly as possible, conform to the rules formulated by the
  1 25 boiler code committee of the American society of mechanical
  1 26 engineers.  Not later than one month following the adoption of
  1 27 ASME code cases by the American society of mechanical
  1 28 engineers relating to equipment covered by this chapter, the
  1 29 commissioner shall adopt emergency rules under section 17A.4,
  1 30 subsection 2, and section 17A.5, subsection 2, paragraph "b",
  1 31 relating to the ASME code cases, and the rules shall be
  1 32 effective immediately upon filing unless a later date is
  1 33 specified in the rules.  Any such emergency rules shall also
  1 34 be published as a notice of intended action as provided in
  1 35 section 17A.4.
  2  1    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2  2 immediate importance, takes effect upon enactment.  
  2  3                           EXPLANATION
  2  4    This bill prohibits the labor commissioner from causing the
  2  5 modification, alteration, or repair of a boiler that will void
  2  6 the boiler's certification by the American society of
  2  7 mechanical engineers (ASME) and the gas appliance
  2  8 manufacturers association of America.  The bill also directs
  2  9 the commissioner to adopt, within one month of the adoption of
  2 10 ASME code cases by ASME relating to equipment covered by the
  2 11 boilers and unfired steam pressure vessels Code chapter,
  2 12 emergency rules relating to the ASME code cases.  The bill
  2 13 defines "ASME code cases" to mean additions and revisions made
  2 14 by ASME to the ASME boiler and pressure vessel code.
  2 15    The bill takes effect upon enactment.
