  1  1    Section 1.  Section 96.4, subsection 3, Code 2003, is
  1  2 amended to read as follows:
  1  3    3.  a.  The individual is able to work, is available for
  1  4 work, and is earnestly and actively seeking work.  To be
  1  5 eligible under this subsection, the individual must:
  1  6    (1)  Be able and available for full-time work for which the
  1  7 individual is fitted by prior training or experience.
  1  8    (2)  Reside in a locality where opportunities for work are
  1  9 not less favorable than those in the locality where the
  1 10 individual resided at the time of the individual's most recent
  1 11 separation from employment.
  1 12    (3)  Actively seek work and keep a record of where and when
  1 13 the individual has sought work and produce such record to the
  1 14 director upon request.
  1 15    (4)  Actively seek work during periods of nonseasonal
  1 16 operations where the individual has been customarily employed
  1 17 in seasonal employment.
  1 18    b.  If an eligible individual is available for work for
  1 19 less than six of seven days in a week, the individual's weekly
  1 20 benefit amount shall be reduced by one-sixth of such amount
  1 21 for each day the individual is unavailable for work.  If an
  1 22 individual is unavailable for work for four days or more in a
  1 23 week, the individual shall be considered unavailable for the
  1 24 entire week.
  1 25    c.  This subsection is waived if the individual is deemed
  1 26 partially unemployed, while employed at the individual's
  1 27 regular job, as defined in section 96.19, subsection 38,
  1 28 paragraph "b", unnumbered paragraph 1, or temporarily
  1 29 unemployed as defined in section 96.19, subsection 38,
  1 30 paragraph "c".  The work search requirements of this
  1 31 subsection and the disqualification requirement for failure to
  1 32 apply for, or to accept suitable work of section 96.5,
  1 33 subsection 3 are waived if the individual is not disqualified
  1 34 for benefits under section 96.5, subsection 1, paragraph "h".  
  1 35                           EXPLANATION
  2  1    This bill provides additional requirements for an
  2  2 individual to be considered able and available to work in
  2  3 order to preclude individuals from being eligible for benefits
  2  4 who are not able or available to work full time, who change
  2  5 the individual's residence to a locality where opportunities
  2  6 to work are less favorable, and to encourage individuals to
  2  7 seek work by requiring individuals to keep a record of the
  2  8 individual's work search and to seek work during periods of
  2  9 the individual's customary nonseasonal work periods.  The bill
  2 10 provides that an individual's weekly benefit amount shall be
  2 11 reduced by one-sixth for each day of six days per week that an
  2 12 individual is unavailable for work, and that if the individual
  2 13 is unavailable for more than four days in one week, the
  2 14 individual shall be considered unavailable for the entire
  2 15 week.
