1 1 Section 1. NEW SECTION. 622.10B ATTORNEY AS WITNESS IN
1 2 CRIMINAL PROCEEDING.
1 3 An attorney who has represented a defendant in a criminal
1 4 proceeding may not testify against the defendant in a criminal
1 5 proceeding unless the defendant does not object to the
1 6 testimony of the attorney, the attorney is a victim of the
1 7 crime that is the subject of the testimony, or the state shows
1 8 that it is unable, without undue hardship, to obtain
1 9 substantially equivalent evidence by other means.
1 10 EXPLANATION
1 11 This bill prohibits an attorney from testifying against a
1 12 defendant in a criminal proceeding if the attorney has also
1 13 represented the defendant in a criminal proceeding. The bill
1 14 provides that an attorney may testify against the criminal
1 15 defendant if the defendant does not object to the attorney
1 16 testifying, the attorney is a victim of a crime that is the
1 17 subject of the testimony, or the state shows that it is
1 18 unable, without undue hardship, to obtain substantially
1 19 equivalent evidence by other means.
