  1  1    Section 1.  NEW SECTION.  35A.13  VETERANS TRUST FUND.
  1  2    1.  For the purposes of this section, "veteran" means the
  1  3 same as defined in section 35.1 or a resident of this state
  1  4 who served in the armed forces of the United States, completed
  1  5 a minimum aggregate of ninety days of active federal service,
  1  6 and was discharged under honorable conditions.
  1  7    2.  A veterans trust fund is created in the state treasury
  1  8 under the control of the commission.
  1  9    3.  The trust fund shall consist of all of the following:
  1 10    a.  Moneys in the form of a devise, gift, bequest,
  1 11 donation, federal or other grant, reimbursement, repayment,
  1 12 judgment, transfer, payment, or appropriation from any source
  1 13 intended to be used for the purposes of the trust fund.
  1 14    b.  Interest attributable to investment of moneys in the
  1 15 fund or an account of the trust fund.  Notwithstanding section
  1 16 12C.7, subsection 2, interest or earnings on moneys in the
  1 17 trust fund shall be credited to the trust fund.
  1 18    4.  Moneys credited to the trust fund shall not be
  1 19 transferred, used, obligated, appropriated, or otherwise
  1 20 encumbered, except as provided in this section.  Moneys in the
  1 21 trust fund may be used for cash flow purposes during a fiscal
  1 22 year provided that any moneys so allocated are returned to the
  1 23 trust fund by the end of that fiscal year.
  1 24    5.  The minimum balance of the trust fund required prior to
  1 25 expenditure of moneys from the trust fund is fifty million
  1 26 dollars.  Once the minimum balance is reached, the interest
  1 27 and earnings on the fund and any moneys received under
  1 28 subsection 3, paragraph "a", are appropriated to the
  1 29 commission to be used to achieve the purposes of this section.
  1 30    6.  Moneys appropriated to the commission under this
  1 31 section may be expended upon a majority vote of the commission
  1 32 membership for the benefit of veterans and the spouses and
  1 33 dependents of veterans, for any of the following purposes:
  1 34    a.  College tuition aid.
  1 35    b.  Job training aid.
  2  1    c.  Veterans nursing facilities.
  2  2    d.  Benefits provided to children of disabled or deceased
  2  3 veterans.
  2  4    e.  Unemployment aid needed during a veteran's unemployment
  2  5 due to prolonged illness or disability resulting from military
  2  6 service.  A diagnosed case of mental distress due to military
  2  7 service-related activities shall be included as a disability
  2  8 under this paragraph.
  2  9    f.  Other purposes identified by the commission.  
  2 10                           EXPLANATION
  2 11    This bill establishes a veterans trust fund under the
  2 12 control of the commission of veterans affairs.
  2 13    New Code section 35A.13 establishes the veterans trust
  2 14 fund.  The fund receives any appropriations and moneys
  2 15 provided for purposes of the fund, and interest and earnings
  2 16 on the moneys credited to the fund.  Moneys in the fund are
  2 17 not subject to appropriation or transfer except as provided by
  2 18 law.  Once the fund reaches a balance of $50 million, the
  2 19 interest and earnings and other moneys credited to the fund in
  2 20 excess of that amount are appropriated to the commission to be
  2 21 used for the purposes of the fund.  The bill specifies that
  2 22 the fund is to be used for the benefit of veterans and the
  2 23 spouses and dependents of veterans for various purposes
  2 24 specified in the bill.  The term "veteran" is defined for
  2 25 purposes of the trust fund as a person listed in the Code
  2 26 section 35.1 definition of veteran, which includes a person
  2 27 who served in the U.S. armed forces during certain periods of
  2 28 armed conflict or war and certain former members of the
  2 29 military reserves and the national guard and veterans of other
  2 30 types of military-related service or a resident of this state
  2 31 who served in the armed forces, completed a minimum aggregate
  2 32 of 90 days of active federal service, and was discharged under
  2 33 honorable conditions.
