1 1 Section 1. Section 457A.1, Code 2003, is amended to read
1 2 as follows:
1 3 457A.1 ACQUISITION BY OTHER THAN CONDEMNATION.
1 4 The department of natural resources, soil and water
1 5 conservation districts as provided in chapter 161A, the
1 6 historical division of the department of cultural affairs, the
1 7 state archaeologist appointed by the state board of regents
1 8 pursuant to section 263B.1, any county conservation board, and
1 9 any city or agency of a city may acquire by purchase, gift,
1 10 contract, or other voluntary means, but not by eminent domain,
1 11 conservation easements in land to preserve scenic beauty,
1 12 wildlife habitat, riparian lands, wetlands, or forests;
1 13 promote outdoor recreation, agriculture, soil or water
1 14 conservation, or open space; or otherwise conserve for the
1 15 benefit of the public the natural beauty, natural and cultural
1 16 resources, and public recreation facilities of the state.
1 17 Sec. 2. Section 161A.11, Code 2003, is repealed.
1 18 EXPLANATION
1 19 CONSERVATION EASEMENTS. This bill amends Code section
1 20 457A.1, which provides that a number of governmental entities
1 21 may acquire conservation easements (other than by eminent
1 22 domain) in land for purposes of preservation. The bill adds
1 23 soil and water conservation districts to the governmental
1 24 entities that are entitled to acquire land under conservation
1 25 easement.
1 26 REPORTING REQUIREMENT. The bill also repeals Code section
1 27 161A.11, which requires the soil conservation division to
1 28 report information to the governor relating to the acreage of
1 29 soil and water conservation districts.
