1 1 Section 1. NEW SECTION. 147.56 SPINAL MANIPULATION OR
1 2 ADJUSTMENT UNLAWFUL PRACTICE.
1 3 1. A license to practice a profession shall be revoked,
1 4 suspended, or subject to nonrenewal or other disciplinary
1 5 action by the board of such profession upon a finding that a
1 6 person licensed under this subtitle other than under chapter
1 7 151, who has not met the requirements of subsection 2 of this
1 8 section, has performed a spinal manipulation or spinal
1 9 adjustment. For the purposes of this section, "spinal
1 10 manipulation" and "spinal adjustment" are interchangeable
1 11 terms that identify a method of skillful and beneficial
1 12 treatment whereby a person uses direct thrust to move a joint
1 13 of the patient's spine beyond its normal range of motion, but
1 14 without exceeding the limits of anatomical integrity.
1 15 2. This section shall not apply to a person who possesses
1 16 the legal authority to utilize differential diagnosis as that
1 17 term is utilized in section 151.1, subsection 3, and who has
1 18 received a minimum of four hundred hours of classroom
1 19 instruction in spinal manipulation or adjustment, and a
1 20 minimum of eight hundred hours of supervised clinical training
1 21 at a facility where spinal manipulation or adjustment is a
1 22 primary method of treatment.
1 23 3. A violation of this section shall be regarded as the
1 24 unlawful practice of chiropractic and pursuant to section
1 25 147.86 shall constitute a serious misdemeanor.
1 26 Notwithstanding section 903.1, a conviction for a first
1 27 offense shall be punishable by a fine not to exceed one
1 28 thousand dollars, imprisonment for a period not to exceed six
1 29 months, or both. A conviction for a second offense shall be
1 30 punishable by a fine not to exceed two thousand dollars,
1 31 imprisonment for a period not to exceed one year, or both.
1 32 EXPLANATION
1 33 This bill provides that a health care professional licensed
1 34 under Code title IV, subtitle 3, who is not a licensed
1 35 chiropractor pursuant to Code chapter 151, shall not perform a
2 1 spinal manipulation or adjustment unless certain conditions
2 2 are met. The bill provides that "spinal manipulation" and
2 3 "spinal adjustment" are interchangeable terms that identify a
2 4 method of skillful and beneficial treatment whereby a person
2 5 uses direct thrust to move a joint of the patient's spine
2 6 beyond its normal range of motion, but without exceeding the
2 7 limits of anatomical integrity.
2 8 The bill provides that a license shall be revoked,
2 9 suspended, or subject to nonrenewal or other disciplinary
2 10 action upon a finding that a spinal manipulation or spinal
2 11 adjustment has been performed, unless the health care
2 12 professional possesses the legal authority to utilize
2 13 differential diagnosis as that term is utilized in Code
2 14 section 151.1, subsection 3, and has received a minimum of 400
2 15 hours of classroom instruction in spinal manipulation or
2 16 adjustment and a minimum of 800 hours of supervised clinical
2 17 training at a facility where spinal manipulation or adjustment
2 18 is a primary method of treatment.
2 19 The bill provides that a violation of these provisions
2 20 shall be regarded as the unlawful practice of chiropractic
2 21 constituting a serious misdemeanor punishable upon conviction
2 22 for a first offense by a fine not to exceed $1,000,
2 23 imprisonment for a period not to exceed six months, or both,
2 24 and upon conviction for a second offense by a fine not to
2 25 exceed $2,000, imprisonment for a period not to exceed one
2 26 year, or both.
