  1  1    Section 1.  NEW SECTION.  457.1  ENVIRONMENTAL OVERSIGHT
  1  2 COMMITTEE.
  1  3    1.  There is created an environmental oversight committee.
  1  4 The committee shall be composed of the following members:
  1  5    a.  Three senators appointed by the majority leader of the
  1  6 senate.
  1  7    b.  Two senators appointed by the minority leader of the
  1  8 senate.
  1  9    c.  Three representatives appointed by the speaker of the
  1 10 house of representatives.
  1 11    d.  Two representatives appointed by the minority leader of
  1 12 the house of representatives.
  1 13    2.  A committee member shall be appointed prior to the
  1 14 adjournment of a regular session of the general assembly
  1 15 convened in an odd-numbered year.  The term of office shall be
  1 16 for four years beginning May 1 of the year of appointment.
  1 17 However, a member shall serve until a successor is appointed.
  1 18 A vacancy on the committee shall be filled by the original
  1 19 appointing authority for the remainder of the term.  A vacancy
  1 20 shall exist whenever a committee member ceases to be a member
  1 21 of the house from which the member was appointed.
  1 22    3.  A committee member shall be paid the per diem specified
  1 23 in section 2.10, subsection 5, for each day in attendance at a
  1 24 meeting of the committee and shall be reimbursed for actual
  1 25 and necessary expenses.  There is appropriated from moneys in
  1 26 the general fund of the state not otherwise appropriated an
  1 27 amount sufficient to pay costs incurred under this section.
  1 28    4.  The committee shall choose a chairperson from its
  1 29 membership and prescribe its rules of procedure.  The
  1 30 committee may employ a secretary or may appoint the director
  1 31 of the legislative service bureau or a designee to act as
  1 32 secretary.
  1 33    5.  A regular committee meeting shall be held at the seat
  1 34 of government on the second Tuesday of each month.  Unless
  1 35 impracticable, in advance of each such meeting, the subject
  2  1 matter to be considered shall be published in the Iowa
  2  2 administrative bulletin.  A special committee meeting may be
  2  3 called by the chairperson at any place in the state and at any
  2  4 time.  Unless impracticable, in advance of each special
  2  5 meeting, notice of the time and place of such meeting and the
  2  6 subject matter to be considered shall be published in the Iowa
  2  7 administrative bulletin.  A regular or special committee
  2  8 meeting shall be open to the public and an interested person
  2  9 may be heard and present evidence.
  2 10    6.  a.  At least sixty days prior to finalizing a proposed
  2 11 agreement with the federal environmental protection agency, a
  2 12 state agency shall notify the committee regarding the proposed
  2 13 agreement.  Proposed agreements that include, at least in
  2 14 part, the transfer of moneys to the state shall not be
  2 15 included under the notification requirements of this
  2 16 paragraph.
  2 17    b.  Notification required under this subsection shall be
  2 18 made in writing to the secretary of the senate and the chief
  2 19 clerk of the house of representatives.  Notification shall
  2 20 include the general nature of the agreement and the name of a
  2 21 person employed with the agency who has knowledge regarding
  2 22 the proposed agreement.
  2 23    c.  The committee shall meet for the purpose of selectively
  2 24 reviewing proposed agreements with the federal environmental
  2 25 protection agency.  The committee may require a representative
  2 26 of an agency whose proposed agreement is under consideration
  2 27 to attend a committee meeting.
  2 28    7.  The committee may refer a proposed agreement to the
  2 29 speaker of the house and the president of the senate at the
  2 30 next regular session of the general assembly.  The speaker and
  2 31 the president shall refer such a proposed agreement to the
  2 32 appropriate standing committee of the general assembly.
  2 33    8.  If the committee objects to a proposed agreement, the
  2 34 committee may submit an objection statement to the agency.  An
  2 35 objection statement shall include general objections or
  3  1 specific suggested changes to the proposed agreement.  This
  3  2 section shall not be construed to prevent a standing committee
  3  3 of the general assembly from reviewing a proposed agreement on
  3  4 its own motion.
  3  5    9.  Notwithstanding section 13.7, the committee may employ
  3  6 necessary legal and technical staff.  
  3  7                           EXPLANATION
  3  8    This bill creates an environmental oversight committee
  3  9 composed of 10 members of the general assembly from both the
  3 10 senate and the house of representatives.  The bill provides
  3 11 for the timing of the appointments to the committee, the
  3 12 selection of a chairperson, the filling of vacancies on the
  3 13 committee, and the employment or appointment of a secretary
  3 14 for the committee.  The bill provides that a committee member
  3 15 shall be paid a per diem for each day in attendance and shall
  3 16 be reimbursed for actual and necessary expenses.  The bill
  3 17 appropriates from moneys in the general fund not otherwise
  3 18 appropriated an amount sufficient to pay costs incurred under
  3 19 the bill.
  3 20    The bill provides that a regular committee meeting shall be
  3 21 held at the seat of government on the second Tuesday of each
  3 22 month and, unless impracticable, in advance of each such
  3 23 meeting, the subject matter to be considered shall be
  3 24 published in the Iowa administrative bulletin.  The bill
  3 25 provides that a special committee meeting may be called by the
  3 26 chairperson at any place in the state and at any time, and
  3 27 unless impracticable, in advance of each special meeting,
  3 28 notice of the time and place of such meeting and the subject
  3 29 matter to be considered shall be published in the Iowa
  3 30 administrative bulletin.
  3 31    The bill provides that, at least 60 days prior to
  3 32 finalizing a proposed agreement with the federal environmental
  3 33 protection agency, a state agency shall notify the committee
  3 34 regarding the proposed agreement.  The bill provides that
  3 35 proposed agreements that include, at least in part, the
  4  1 transfer of moneys to the state shall not be included under
  4  2 the notification requirements.  The bill provides for the
  4  3 method of notification and the content of the required
  4  4 notification.  The bill provides that the committee shall meet
  4  5 for the purpose of selectively reviewing proposed agreements
  4  6 with the federal environmental protection agency.  The bill
  4  7 provides that a regular or special committee meeting shall be
  4  8 open to the public and an interested person may be heard and
  4  9 present evidence.  The bill provides that the committee may
  4 10 require a representative of an agency whose proposed agreement
  4 11 is under consideration to attend a committee meeting.
  4 12    The bill provides that the committee may refer a proposed
  4 13 agreement to the speaker of the house and the president of the
  4 14 senate at the next regular session of the general assembly and
  4 15 that such proposed agreements shall be referred by the speaker
  4 16 and the president to the appropriate standing committee of the
  4 17 general assembly.
  4 18    The bill provides that, if the committee objects to a
  4 19 proposed agreement, the committee may submit an objection
  4 20 statement to the agency.  An objection statement shall include
  4 21 general objections or specific suggested changes to the
  4 22 proposed agreement.  The bill provides that a standing
  4 23 committee of the general assembly may review a proposed
  4 24 agreement on its own motion.
