  1  1    Section 1.  Section 279.35, Code 2003, is amended to read
  1  2 as follows:
  1  3    279.35  PUBLICATION OR POSTING OF PROCEEDINGS.
  1  4    The proceedings of each regular, adjourned, or special
  1  5 meeting of the board, including the schedule of bills allowed,
  1  6 shall be published or posted after the adjournment of the
  1  7 meeting in the manner provided in this section and section
  1  8 279.36, and the publication or posting of the schedule of the
  1  9 bills allowed shall include a list of claims allowed,
  1 10 including salary claims for services performed.  The schedule
  1 11 of bills allowed may be published or posted on a once monthly
  1 12 basis in lieu of publication or posting with the proceedings
  1 13 of each meeting of the board.  The list of claims allowed
  1 14 shall include the name of the person or firm making the claim,
  1 15 the purpose of the claim, and the amount of the claim.
  1 16 However, salaries paid to individuals regularly employed by
  1 17 the district shall only be published or posted annually and
  1 18 the publication or posting shall include the total amount of
  1 19 the annual salary of each employee.  The secretary shall
  1 20 furnish a copy of the proceedings to be published or posted
  1 21 within two weeks following the adjournment of the meeting.
  1 22    Sec. 2.  Section 279.36, Code 2003, is amended to read as
  1 23 follows:
  1 24    279.36  PUBLICATION AND POSTING PROCEDURES AND – NEWSPAPER
  1 25 FEE.
  1 26    The requirements of section 279.35 are satisfied by
  1 27 publication in at least one newspaper published in the
  1 28 district or, if there is none, in at least one newspaper
  1 29 having general circulation within the district, or by posting,
  1 30 which may be by electronic means, in a manner determined to
  1 31 apprise the members of the public residing in the district of
  1 32 the board minutes, bills, and salaries.
  1 33    For the fiscal year beginning July 1, 1987, the fee for
  1 34 publications required under section 279.35 shall not exceed
  1 35 three-fifths of the legal publication fee provided by statute
  2  1 for the publication of legal notices.  For the fiscal year
  2  2 beginning July 1, 1988, the fee for the publications shall not
  2  3 exceed three-fourths of that legal publication fee.  For If
  2  4 the board publishes the proceedings of each regular,
  2  5 adjourned, or special meeting of the board, including the
  2  6 schedule of bills and claims allowed and salaries paid in
  2  7 accordance with section 279.35, for the fiscal year beginning
  2  8 July 1, 1989, and each fiscal year thereafter, the fee for the
  2  9 publications publication shall be the legal publication fee
  2 10 provided by statute.
  2 11    Sec. 3.  Section 297.22, subsection 1, unnumbered paragraph
  2 12 4, Code 2003, is amended to read as follows:
  2 13    However, property having a value of not more than five
  2 14 thousand dollars, other than real property, may be disposed of
  2 15 by any procedure which is adopted by the board and each sale
  2 16 shall be published by at least one insertion each week for two
  2 17 consecutive weeks in a newspaper having general circulation in
  2 18 the district.  
  2 19                           EXPLANATION
  2 20    This bill eliminates language that requires a school board,
  2 21 area education agency, or community college board to publish
  2 22 the sale of property with a value of $5,000 or less in a
  2 23 newspaper once a week for two consecutive weeks prior to
  2 24 disposal of the property.  The bill also adds an alternative
  2 25 to the current Code provision that requires a school board to
  2 26 publish in a newspaper published or having general circulation
  2 27 within the school district, the proceedings of each regular,
  2 28 adjourned, or special meeting of the board, including the
  2 29 schedule of bills and claims allowed and the salaries paid to
  2 30 individuals regularly employed by the district.  The bill
  2 31 permits the board to post the information, by electronic means
  2 32 if desired, in a manner determined to apprise members of the
  2 33 public residing in the school district of the information.
