PAG LIN 1 1 Section 1. Section 331.341, Code 2003, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 6. The provisions of sections 384.95 1 4 through 384.103 apply to any public improvement the estimated 1 5 cost for which exceeds the amount specified in section 309.40 1 6 and which is undertaken jointly by the county and another 1 7 county or by the county and the state or any other political 1 8 subdivision of the state, and a county may enter into an 1 9 agreement for such purpose under the provisions of chapter 1 10 28E, but any requirement of those sections in respect to 1 11 approval of detailed plans and specifications, calling for 1 12 construction bids, awarding construction contracts, and 1 13 acceptance of the completed improvement may be carried out by 1 14 each county with other counties, the state, or any other 1 15 political subdivision of the state, as provided in an 1 16 agreement entered into as permitted by chapter 28E. 1 17 Sec. 2. Section 357A.12, unnumbered paragraph 2, Code 1 18 2003, is amended to read as follows: 1 19 The procedures for contract letting specified in sections 1 20 384.95 through 384.102,andas specified in section 384.103, 1 21 subsection 2, and in section 384.104 shall apply to 1 22 construction carried out pursuant to this chapter. References 1 23 in those sections to a city shall be applicable to a rural 1 24 water district operating under this chapter, and references to 1 25 a city council shall be applicable to the board of directors 1 26 of a rural water district. 1 27 Sec. 3. NEW SECTION. 384.104 APPLICATION TO JOINT 1 28 UNDERTAKINGS. 1 29 The provisions of this division apply to any public 1 30 improvement undertaken jointly by the city and another city or 1 31 by the city and the state or any other political subdivision 1 32 of the state, and a city may enter into an agreement for such 1 33 purpose under the provisions of chapter 28E, but any 1 34 requirement of this part in respect to approval of detailed 1 35 plans and specifications, calling for construction bids, 2 1 awarding construction contracts, and acceptance of the 2 2 completed improvement may be carried out by each city with 2 3 other cities, the state, or any other political subdivision of 2 4 the state, as provided in an agreement entered into as 2 5 permitted by chapter 28E. However, when a public improvement 2 6 is undertaken jointly by a city and a county, the provisions 2 7 of this division apply when the estimated cost of the public 2 8 improvement exceeds the amount specified in section 309.40. 2 9 Sec. 4. Section 390.3, unnumbered paragraph 2, Code 2003, 2 10 is amended to read as follows: 2 11 However, in the performance of a joint agreement, the 2 12 governing body is not subject to statutes generally applicable 2 13 to public contracts, including hearings on plans, 2 14 specifications, form of contracts, costs, notice and 2 15 competitive bidding required under sections 384.95 through 2 16384.103384.104, unless all parties to the joint agreement are 2 17 cities located within the state of Iowa. 2 18 2 19 EXPLANATION 2 20 This bill requires that when a city or a county is a party 2 21 to an agreement with the state or a political subdivision of 2 22 the state for joint construction of a public improvement, 2 23 contracts entered into for construction of the public 2 24 improvement must follow the contract letting procedures 2 25 currently required of cities and counties. However, when the 2 26 public improvement is jointly undertaken by a city and county, 2 27 the estimated cost threshold is that of the county. 2 28 The bill applies by operation of law to rural water 2 29 districts and joint electrical utilities. 2 30 LSB 2339HC 80 2 31 sc/pj/5
