  1  1    Section 1.  Section 321.236, subsection 1, paragraph a,
  1  2 Code 2003, is amended to read as follows:
  1  3    a.  May be charged and collected upon a simple notice of a
  1  4 fine payable to the city clerk or clerk of the district court,
  1  5 if authorized by ordinance.  The fine shall not exceed five
  1  6 dollars except for snow route parking violations in which case
  1  7 the fine shall not exceed twenty-five dollars.  The fine may
  1  8 be increased up to ten dollars if the parking violation is not
  1  9 paid within thirty days of the date upon which the violation
  1 10 occurred, if authorized by ordinance.  Violations of section
  1 11 321L.4, subsection 2, may be charged and collected upon a
  1 12 simple notice of a one hundred dollar fine payable to the city
  1 13 clerk or clerk of the district court, if authorized by
  1 14 ordinance.  No costs or other charges shall be assessed,
  1 15 except the actual costs of providing the simple notice may be
  1 16 charged and collected.  All fines and actual costs collected
  1 17 by a city pursuant to this paragraph shall be retained by the
  1 18 city and all fines and actual costs collected by a county
  1 19 pursuant to this paragraph shall be retained by the county.  
  1 20                           EXPLANATION
  1 21    This bill relates to motor vehicle parking violations.
  1 22    The bill provides that a local authority may charge a
  1 23 parking ordinance violator the actual costs of providing the
  1 24 notice of a parking violation.  The bill applies only to
  1 25 parking ordinance violators who have admitted to the
  1 26 violation.  If the alleged violator challenges the parking
  1 27 violation in court, current law provides for the assessment of
  1 28 costs as provided in Code section 602.8106, subsection 1,
  1 29 paragraph "c".
  1 30    Current law does not permit a local authority to collect
  1 31 the actual costs of providing the notice of an admitted
  1 32 parking violation.  A parking violation fine other than a snow
  1 33 route parking violation fine or a persons with disabilities
  1 34 parking violation fine is capped by Code section 321.236 at $5
  1 35 if paid on time.
