  1  1    Section 1.  NEW SECTION.  461A.3B  PREMIER DESTINATION PARK
  1  2 PROGRAM.
  1  3    1.  The department shall establish a premier destination
  1  4 park program.  The purpose of the program is to provide
  1  5 funding for the planning and design, and construction of new
  1  6 vertical infrastructure as defined in section 8.57, subsection
  1  7 5, paragraph "c", for a premier destination park only if
  1  8 attendant investment is made in the park by private industry.
  1  9    2.  There is appropriated from the tax-exempt bond proceeds
  1 10 restricted capital funds account of the tobacco settlement
  1 11 trust fund established in section 12E.12, subsection 1,
  1 12 paragraph "b", subparagraph (1), for each fiscal year of the
  1 13 fiscal period beginning July 1, 2003, and ending June 30,
  1 14 2008, the sum of three million dollars to the department for
  1 15 use in the premier destination park program.  Notwithstanding
  1 16 section 8.33, unencumbered or unobligated moneys remaining at
  1 17 the end of a fiscal year shall not revert but shall remain
  1 18 available for expenditure during the following fiscal year for
  1 19 purposes of the premier destination park program.
  1 20    The department shall provide a report, in its annual budget
  1 21 documentations to the governor and general assembly, on the
  1 22 use of moneys under the program since the last report and the
  1 23 projected use of future moneys.  
  1 24                           EXPLANATION
  1 25    This bill creates a new program in the department of
  1 26 natural resources called the premier destination park program.
  1 27 The purpose of the program is to provide funding for the
  1 28 planning and design, and construction of new vertical
  1 29 infrastructure for a premier destination park only if
  1 30 attendant investment is made in the park by private industry.
  1 31    "Vertical infrastructure" is defined in Code section 8.57,
  1 32 subsection 5, paragraph "c", as including only land
  1 33 acquisition and construction, major renovation and major
  1 34 repair of buildings, all appurtenant structures, utilities,
  1 35 site development, and recreational trails.  "Vertical
  2  1 infrastructure" does not include routine, recurring
  2  2 maintenance or operational expenses or leasing of a building,
  2  3 appurtenant structure, or utility without a lease-purchase
  2  4 agreement.
  2  5    Funds for the program are appropriated to the department
  2  6 from the tax-exempt bond proceeds restricted capital funds
  2  7 account of the tobacco settlement trust fund in the amount of
  2  8 $3 million for each fiscal year of the fiscal period beginning
  2  9 July 1, 2003, and ending June 30, 2008.  Unencumbered or
  2 10 unobligated moneys remaining at the end of a fiscal year do
  2 11 not revert but remain available for expenditure during the
  2 12 following year for the purposes of the premier destination
  2 13 park program, notwithstanding Code section 8.33.
  2 14    The department is required to provide a report in its
  2 15 annual budget documentations to the governor and general
  2 16 assembly on the use of moneys under the program since the last
  2 17 report and the projected use of future moneys.
