  1  1    Section 1.  The following amendment to the Constitution of
  1  2 the State of Iowa is proposed:
  1  3    Article I of the Constitution of the State of Iowa is
  1  4 amended by adding the following new section:
  1  5    MARRIAGE.  SEC. 26.  Marriage in this State shall consist
  1  6 only of the legal union of one man and one woman as husband
  1  7 and wife.  The exclusive legal union, incidents, privileges,
  1  8 and immunities of the legal status of marriage shall not be
  1  9 conferred upon, contracted for, or otherwise enjoyed by
  1 10 unmarried couples or groups of persons.  A marriage solemnized
  1 11 and valid in any other state, territory, country, or foreign
  1 12 jurisdiction is valid in this State if it is not contrary to
  1 13 this section and it satisfies all other requirements of State
  1 14 law.  A civil contract valid in any other state, territory,
  1 15 country, or foreign jurisdiction that does not confer the
  1 16 legal status of marriage but only confers the exclusive legal
  1 17 union, incidents, privileges, or immunities of such status on
  1 18 an unmarried couple or group of persons is not valid in this
  1 19 State.
  1 20    Sec. 2.  REFERRAL AND PUBLICATION.  The foregoing amendment
  1 21 to the Constitution of the State of Iowa is referred to the
  1 22 General Assembly to be chosen at the next general election for
  1 23 members of the General Assembly and the Secretary of State is
  1 24 directed to cause the same to be published for three
  1 25 consecutive months previous to the date of that election as
  1 26 provided by law.  
  1 27                           EXPLANATION
  1 28    This joint resolution proposes an amendment to the
  1 29 Constitution of the State of Iowa regarding what constitutes a
  1 30 marriage and the legal incidents, privileges, or immunities of
  1 31 marriage in this state.  The resolution, if adopted, would be
  1 32 referred to the next general assembly for adoption a second
  1 33 time before being submitted to the electorate for
  1 34 ratification.
