PAG LIN 1 1 HOUSE FILE 2571 1 2 1 3 AN ACT 1 4 RELATING TO AGRICULTURE BY PROVIDING FOR REPORTING REQUIRE- 1 5 MENTS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 10B.4, subsection 1, Code 2003, is 1 10 amended to read as follows: 1 11 1.An annualA biennial report shall be filed by a 1 12 reporting entity with the secretary of state on or before 1 13 March 31 of each odd-numbered year as required by rules 1 14 adopted by the secretary of state pursuant to chapter 17A. 1 15 However, a reporting entity required to file a biennial report 1 16 pursuant to chapter 490, 496C, 497, 498, 499, 501, or 504A, 1 17 shall file the report required by this section in the same 1 18 year as required by that chapter. The reporting entity may 1 19 file the report required by this section together with the 1 20 biennial report required to be filed by one of the other 1 21 chapters referred to in this subsection. The reports shall be 1 22 filed on forms prepared and supplied by the secretary of 1 23 state. The secretary of state may provide for combining its 1 24 reporting forms with other biennial reporting forms required 1 25 to be used by the reporting entities. 1 26 Sec. 2. Section 10B.4, subsection 2, unnumbered paragraph 1 27 1, Code 2003, is amended to read as follows: 1 28 A report required pursuant to this section shall contain 1 29 information for thelast yearreporting period regarding the 1 30 reporting entity as required by the secretary of state which 1 31 shall at least include all of the following: 1 32 Sec. 3. Section 10B.4, subsection 3, Code 2003, is amended 1 33 to read as follows: 1 34 3. A reporting entity other than a foreign business, 1 35 foreign government, or nonresident alien shall be excused from 2 1 filing a report with the secretary of state during anyyear2 2 reporting period in which the reporting entity holds an 2 3 interest in less than twenty acres of agricultural land in 2 4 this state and the gross revenue produced from all farming on 2 5 the land equals less than ten thousand dollars. 2 6 Sec. 4. Section 10B.5, subsection 2, Code 2003, is amended 2 7 to read as follows: 2 8 2. Information provided in reports required in this 2 9 chapter is a confidential record as provided in section 22.7. 2 10 The attorney general may have access to the reports, and may 2 11 use information in the reports in any action to enforce state 2 12 law, including but not limited to chapters 9H, 9I, and 10C. 2 13 The reports shall be made available to members of the general 2 14 assembly and appropriate committees of the general assembly in 2 15 order to determine the extent that agricultural land is held 2 16 in this state by corporations and other business and foreign 2 17 entities and the effect of such land ownership upon the 2 18 economy of this state. The secretary of state shall assist 2 19 any committee of the general assembly studying these issues. 2 20 Sec. 5. Section 10B.7, unnumbered paragraph 1, Code 2 21 Supplement 2003, is amended to read as follows: 2 22 Lessees of agricultural land under section 9H.4, subsection 2 23 2, paragraph "c", for research or experimental purposes, shall 2 24 file a biennial report with the secretary of state on or 2 25 before March 31 of each odd-numbered year on forms adopted 2 26 pursuant to chapter 17A and supplied by the secretary of 2 27 state. However, a lessee required to file a biennial report 2 28 pursuant to chapter 490, 496C, 497, 498, 499, 501, or 504A, 2 29 shall file the report required by this section in the same 2 30 year as required by that chapter. The lessee may file the 2 31 report required by this section together with the biennial 2 32 report required to be filed by one of the other chapters 2 33 referred to in this paragraph. The report shall contain the 2 34 following information for thelast yearreporting period: 2 35 Sec. 6. Section 22.7, Code Supplement 2003, is amended by 3 1 adding this following new subsection: 3 2 NEW SUBSECTION. 48. A report regarding interest held in 3 3 agricultural land required to be filed pursuant to chapter 3 4 10B. 3 5 3 6 3 7 3 8 CHRISTOPHER C.
