  1  4 RELATING TO EXPENDITURES FROM THE WASTE TIRE MANAGEMENT FUND.

  1  6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  7 
  1  8    Section 1.  Section 455D.11C, subsections 2 and 3, Code
  1  9 2003, are amended by striking the subsections and inserting in
  1 10 lieu thereof the following:
  1 11    2.  Moneys in the waste tire management fund are
  1 12 appropriated and shall be used for the following purposes:
  1 13    a.  Thirty percent of the moneys shall be used for all of
  1 14 the following positions:
  1 15    (1)  One full-time equivalent position for the
  1 16 administration of permits and registrations for tire
  1 17 processing, storage, and hauling activities, and tire program
  1 18 initiatives.
  1 19    (2)  One and one-half full-time equivalent positions for
  1 20 waste tire-related compliance checks and inspections.  The
  1 21 full-time equivalent positions shall be divided equally
  1 22 between the field offices in the state.
  1 23    b.  Ten percent of the moneys shall be used for a public
  1 24 education and awareness initiative related to the proper tire
  1 25 disposal options and environmental and health hazards posed by
  1 26 improper tire storage.
  1 27    c.  Thirty percent of the moneys shall be used for market
  1 28 development initiatives for waste tires.
  1 29    d.  Thirty percent of the moneys shall be used for waste
  1 30 tire stockpile abatement initiatives which would require a
  1 31 cost-share agreement with the landowner.
  1 32    Sec. 2.  Sections 455D.11D, 455D.11E, 455D.11F, and
  1 33 455D.11H, Code 2003, are repealed.
  1 34    Sec. 3.  UNENCUMBERED OR UNOBLIGATED MONEYS –
  1 35 APPROPRIATION.  On July 1, 2004, any unencumbered or
  2  1 unobligated moneys that were awarded from the waste tire
  2  2 management fund pursuant to section 455D.11C, subsection 2,
  2  3 Code 2003, shall revert to the waste tire management fund and
  2  4 shall be reallocated and appropriated pursuant to section
  2  5 455D.11C, subsection 2, paragraph "a", as amended in this Act.
  2  6 Commencing with the fiscal year ending June 30, 2005, and each
  2  7 subsequent fiscal year through June 30, 2007, any unencumbered
  2  8 or unobligated moneys that were awarded from the waste tire
  2  9 management fund pursuant to section 321.52A, subsection 2,
  2 10 shall remain in the waste tire management fund and shall be
  2 11 used as appropriated pursuant to section 455D.11C, subsection
  2 12 2, as amended in this Act.
