  1  4 PROVIDING FOR ANIMAL AGRICULTURE, INCLUDING BY PROVIDING FOR
  1  5    OFFENSES INVOLVING ANIMALS AND CROPS AND RELATED PROPERTY,
  1  6    AND PROVIDING PENALTIES.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 717A.2, subsection 3, paragraph a, Code
  1 11 Supplement 2003, is amended to read as follows:
  1 12    a.  A person who violates subsection 1, paragraph "a", is
  1 13 guilty of a class "C" felony if the injury to or death of an
  1 14 animal or damage to property exceeds fifty ten thousand
  1 15 dollars, a class "D" felony if the injury to or death of an
  1 16 animal or damage to property exceeds five hundred one thousand
  1 17 dollars but does not exceed fifty ten thousand dollars, an
  1 18 aggravated misdemeanor if the injury to or death of an animal
  1 19 or damage to property exceeds one hundred dollars but does not
  1 20 exceed five hundred one thousand dollars, a serious
  1 21 misdemeanor if the injury to or death of an animal or damage
  1 22 to property exceeds fifty dollars but does not exceed one
  1 23 hundred dollars, or a simple misdemeanor if the injury to or
  1 24 death of an animal or damage to property does not exceed fifty
  1 25 dollars.
  1 26    Sec. 2.  NEW SECTION.  717A.4  PATHOGENS THREATENING
  1 27 ANIMALS AND CROPS – PENALTY.
  1 28    1.  Except as provided in subsection 2, a person shall not
  1 29 willfully possess, transport, or transfer a pathogen with an
  1 30 intent to threaten the health of an animal or crop.
  1 31    a.  For animals, a pathogen restricted under this section
  1 32 shall be limited to a biological agent or toxin listed in 9
  1 33 C.F.R. } 121.2(b), as that list exists on January 1, 2004.
  1 34    b.  For crops, a pathogen restricted under this section
  1 35 shall be limited to a biological agent or toxin listed in 7
  2  1 C.F.R. } 331.3, as that list exists on January 1, 2004.
  2  2    2.  This section does not apply to a person who possesses,
  2  3 transports, or distributes a pathogen in compliance with
  2  4 federal law, including but not limited to as provided in 9
  2  5 C.F.R. pt. 121 or 7 C.F.R. pt. 331.
  2  6    3.  A person who violates this section is guilty of a class
  2  7 "B" felony.
