  1  4 RELATING TO THE REGULATION OF TARGET SHOOTING NEAR BUILDINGS
  1  5    AND FEEDLOTS AND THE REGULATION OF PUBLIC HUNTING NEAR
  1  6    BUILDINGS AND FEEDLOTS AND PROVIDING AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 481A.123, Code 2003, is amended by
  1 11 adding the following new subsections:
  1 12    NEW SUBSECTION.  3.  This section does not apply to the
  1 13 discharge of a firearm for the purpose of target shooting on
  1 14 premises posted as a target shooting range that is open to the
  1 15 public, if the premises have been used as a target shooting
  1 16 range prior to the erection of a building inhabited by people
  1 17 or domestic livestock, or prior to the construction of a
  1 18 feedlot, located within two hundred yards of the target
  1 19 shooting range.  This subsection applies only to the erection
  1 20 of a building inhabited by people or domestic livestock or to
  1 21 the construction of a feedlot located within two hundred yards
  1 22 of a target shooting range that is open to the public and that
  1 23 is identified as a target shooting range by the city, county,
  1 24 state, or federal government, which erection or construction
  1 25 occurs on or after the effective date of this Act.
  1 26    As used in this subsection, "target shooting" means the
  1 27 discharge of a firearm at an inanimate object, for amusement
  1 28 or as a test of skill in marksmanship.
  1 29    NEW SUBSECTION.  4.  This section does not apply to the
  1 30 discharge of a firearm on premises identified as a public
  1 31 hunting area, if the premises have been identified as a public
  1 32 hunting area prior to the erection of a building inhabited by
  1 33 people or domestic livestock, or prior to the construction of
  1 34 a feedlot, located within two hundred yards of the public
  1 35 hunting area.  This subsection applies only to the erection of
  2  1 a building inhabited by people or domestic livestock or to the
  2  2 construction of a feedlot located within two hundred yards of
  2  3 a public hunting area, which erection or construction occurs
  2  4 on or after the effective date of this Act.
  2  5    As used in this subsection, "public hunting area" means
  2  6 public lands or waters available for hunting by the public,
  2  7 and identified as a public hunting area by the city, county,
  2  8 state, or federal government.
  2  9    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  2 10 immediate importance, takes effect upon enactment.
