1 1 Section 1. Section 170.3, Code Supplement 2003, is amended
1 2 by adding the following new subsection:
1 3 NEW SUBSECTION. 3. The department may impose, assess, and
1 4 collect fees as required to administer this chapter. However,
1 5 the department shall not charge a person a fee that exceeds
1 6 ten dollars.
1 7 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 8 immediate importance, takes effect upon enactment.
1 9 EXPLANATION
1 10 During the 2003 legislative session the General Assembly
1 11 passed House File 624 (2003 Acts, chapter 149) regulating farm
1 12 deer, including whitetail deer. The bill effectively
1 13 transferred regulatory authority from the department of
1 14 natural resources under Code chapter 484 (which supervises
1 15 hunting preserves) to the department of agriculture and land
1 16 stewardship under new Code chapter 170. That Code chapter
1 17 does not currently provide for the assessment of fees. This
1 18 bill provides that the department may impose, assess, and
1 19 collect fees as required to administer the chapter. The bill
1 20 also provides that a fee cannot exceed $10.
