  1  1    Section 1.  Section 455D.11C, subsections 2 and 3, Code
  1  2 2003, are amended by striking the subsections and inserting in
  1  3 lieu thereof the following:
  1  4    2.  Moneys in the waste tire management fund are
  1  5 appropriated and shall be used for the following purposes:
  1  6    a.  Thirty percent of the moneys shall be used for all of
  1  7 the following positions:
  1  8    (1)  One full-time equivalent position for the
  1  9 administration of permits and registrations for tire
  1 10 processing, storage, and hauling activities, and tire program
  1 11 initiatives.
  1 12    (2)  One and one-half full-time equivalent positions for
  1 13 waste tire-related compliance checks and inspections.  The
  1 14 full-time equivalent positions shall be divided equally
  1 15 between the field offices in the state.
  1 16    b.  Ten percent of the moneys shall be used for a public
  1 17 education and awareness initiative related to the proper tire
  1 18 disposal options and environmental and health hazards posed by
  1 19 improper tire storage.
  1 20    c.  Thirty percent of the moneys shall be used for market
  1 21 development initiatives for waste tires.
  1 22    d.  Thirty percent of the moneys shall be used for waste
  1 23 tire stockpile abatement initiatives which would require a
  1 24 cost-share agreement with the landowner.
  1 25    Sec. 2.  Sections 455D.11D, 455D.11E, 455D.11F, and
  1 26 455D.11H, Code 2003, are repealed.
  1 27    Sec. 3.  UNENCUMBERED OR UNOBLIGATED MONEYS –
  1 28 APPROPRIATION.  On July 1, 2004, any unencumbered or
  1 29 unobligated moneys that were awarded from the waste tire
  1 30 management fund pursuant to section 455D.11C, subsection 2,
  1 31 Code 2003, shall revert to the waste tire management fund and
  1 32 shall be reallocated and appropriated pursuant to section
  1 33 455D.11C, subsection 2, paragraph "a", as amended in this Act.
  1 34 Commencing with the fiscal year ending June 30, 2005, and each
  1 35 subsequent fiscal year through June 30, 2007, any unencumbered
  2  1 or unobligated moneys that were awarded from the waste tire
  2  2 management fund pursuant to section 321.52A, subsection 2,
  2  3 shall remain in the waste tire management fund and shall be
  2  4 used as appropriated pursuant to section 455D.11C, subsection
  2  5 2, as amended in this Act.  
  2  6                           EXPLANATION
  2  7    This bill appropriates moneys in the waste tire management
  2  8 fund.
  2  9    The bill changes the appropriations from the waste tire
  2 10 management fund.  The bill changes the appropriations to
  2 11 provide the following:
  2 12    1.  Of the moneys in the fund, 30 percent shall be used for
  2 13 2.50 FTEs in the department of natural resources.  One FTE
  2 14 shall be for the administration of permits and registrations
  2 15 for tire processing, storage, and hauling activities, and tire
  2 16 program initiatives.  One and one-half FTEs shall be for waste
  2 17 tire-related compliance checks and inspections at field
  2 18 offices around the state.
  2 19    2.  Of the moneys in the fund, 10 percent shall be used for
  2 20 a public education and awareness initiative related to the
  2 21 proper tire disposal options and environmental and health
  2 22 hazards posed by improper tire storage.
  2 23    3.  Of the moneys in the fund, 30 percent shall be used for
  2 24 market development initiatives for waste tires.
  2 25    4.  Of the moneys in the fund, 30 percent shall be used for
  2 26 waste tire stockpile abatement initiatives which would require
  2 27 a cost-share agreement with the landowner.
  2 28    The bill repeals a future repeal of the waste tire
  2 29 management fund.  The bill repeals the waste tire grant
  2 30 program and programs awarding moneys to regents institutions
  2 31 for using tire-derived fuel and end-users of processed waste
  2 32 tires.
  2 33    The bill provides that, on July 1, 2004, any unencumbered
  2 34 or unobligated moneys that were awarded from the waste tire
  2 35 management fund shall revert to the waste tire management fund
  3  1 and shall be reallocated and appropriated to fund the 2.50
  3  2 FTEs created in the bill.  The bill provide that, commencing
  3  3 with the fiscal year ending June 30, 2005, and each subsequent
  3  4 fiscal year through June 30, 2007, any unencumbered or
  3  5 unobligated moneys that are awarded from the waste tire
  3  6 management fund shall remain in the fund and shall be
  3  7 appropriated pursuant to the provisions of the bill.
