PAG LIN 1 1 HOUSE FILE 2343 1 2 1 3 AN ACT 1 4 PROVIDING FOR THE ESTABLISHMENT OF A VACCINATION PROGRAM FOR 1 5 FIRST RESPONDERS, AND PROVIDING AN IMMEDIATE EFFECTIVE DATE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. NEW SECTION. 135.146 FIRST RESPONDER 1 10 VACCINATION PROGRAM. 1 11 1. In the event that federal funding is received for 1 12 administering vaccinations for first responders, the 1 13 department shall offer a vaccination program for first 1 14 responders who may be exposed to infectious diseases when 1 15 deployed to disaster locations. For purposes of this section, 1 16 "first responder" means state and local law enforcement 1 17 personnel, fire department personnel, and emergency medical 1 18 personnel who will be deployed to sites of bioterrorism 1 19 attacks, terrorist attacks, catastrophic or natural disasters, 1 20 and other disasters. The vaccinations shall include, but not 1 21 be limited to, vaccinations for hepatitis B, diphtheria- 1 22 tetanus, influenza, and other vaccinations when recommended by 1 23 the United States public health service and in accordance with 1 24 federal emergency management agency policy. Immune globulin 1 25 will be made available when necessary. 1 26 2. Participation in the vaccination program shall be 1 27 voluntary, except for first responders who are classified as 1 28 having occupational exposure to blood-borne pathogens as 1 29 defined by the occupational safety and health administration 1 30 standard contained in 29 C.F.R. } 1910.1030. First responders 1 31 who are so classified shall be required to receive the 1 32 vaccinations as described in subsection 1. A first responder 1 33 shall be exempt from this requirement, however, when a written 1 34 statement from a licensed physician is presented indicating 1 35 that a vaccine is medically contraindicated for that person or 2 1 the first responder signs a written statement that the 2 2 administration of a vaccination conflicts with religious 2 3 tenets. 2 4 3. The department shall establish first responder 2 5 notification procedures regarding the existence of the program 2 6 by rule, and shall develop, and distribute to first 2 7 responders, educational materials on methods of preventing 2 8 exposure to infectious diseases. In administering the 2 9 program, the department may contract with county and local 2 10 health departments, not-for-profit home health care agencies, 2 11 hospitals, physicians, and military unit clinics. 2 12 Sec. 2.
