  1 2 – RESTRICTIONS – PENALTY.
  1 3 1. a. Notwithstanding section 481C.2, an owner of a farm
1 4 unit, as defined in section 483A.24, who incurs crop or
1 5 nursery damage caused by deer may apply to the department of
1 6 natural resources for a deer depredation permit or permits for
1 7 each farm unit where the damage has occurred. The department
1 8 shall specify, by rule, a proportional number of permits which
1 9 may be issued at no cost to an applicant for each farm unit,
1 10 based on the size of the farm unit, damage done, and deer
1 11 population. The application shall specify the crops or
1 12 nursery stock damaged, the estimated amount of damage, and the
1 13 area of the farm unit where the damage occurred. Each permit
1 14 issued is valid only from September 1 through the succeeding
1 15 March 1 for taking a deer of either sex on the farm unit
1 16 specified in the application.
1 17 b. If additional deer depredation damage occurs on a farm
1 18 unit after all permits issued for the farm unit have been
1 19 used, additional depredation permits for the farm unit may be
1 20 issued at no cost to the applicant, upon the approval of a
1 21 representative of the department. A postcard shall be issued
1 22 with each depredation permit. A person taking a deer with a
1 23 depredation permit shall complete and return the postcard to
1 24 the department within ten days after taking the deer. An
1 25 unused depredation permit and postcard shall be returned to
1 26 the department by March 10 following the expiration of the
  1 27 depredation permit.
1 28 2. An owner of a farm unit who has been issued a deer
1 29 depredation permit pursuant to subsection 1 may give the deer
1 30 depredation permit to hunt on the specified farm unit to any
1 31 person who is otherwise licensed, except for a deer license,
1 32 to hunt in this state. If a deer depredation permit is used
1 33 by any person other than the landowner, the name and address
1 34 of the user shall be legibly written on the permit and on the
  1 35 return postcard.
2 1 3. Except during a regular shotgun season, any bow and
2 2 arrow or any legal firearm may be used to take a deer with a
  2 3 deer depredation permit.
2 4 4. A person who violates this section or a rule adopted
2 5 under this section is guilty of a simple misdemeanor which is
2 6 punishable as a scheduled violation under section 805.8B,
  2 7 subsection 3, paragraph "e".
  2 8 Sec. 2. Section 805.8B, subsection 3, paragraph e, Code

  2 13 dollars.
  2 14 EXPLANATION
2 15 This bill authorizes the owner of a farm unit which has
2 16 incurred crop or nursery damage caused by deer to apply to the
2 17 department of natural resources for deer depredation permits
2 18 for each farm unit where the damage has occurred. The bill
2 19 provides that the department shall specify, by rule, a
2 20 proportional number of depredation permits which may be issued
2 21 at no cost to an applicant, based on the size of the farm
2 22 unit, damage done, and deer population. The application shall
2 23 specify the crops or nursery stock damaged, the estimated
2 24 amount of damage, and the area of the farm unit where the
2 25 damage occurred. Each permit issued is valid only from
2 26 September 1 through the succeeding March 1 for taking a deer
2 27 of either sex on the farm unit specified in the application.
2 28 If additional damage occurs on a farm unit after all permits
2 29 issued for a farm unit have been used, additional permits may
2 30 be issued at no cost, upon the approval of a representative of
2 31 the department. A postcard shall be issued with each
2 32 depredation permit which shall be completed and returned by
2 33 the hunter within 10 days after taking a deer. An unused
2 34 depredation permit and postcard shall be returned to the
  2 35 department by March 10.
3 1 An owner of a farm unit who has been issued a deer
3 2 depredation permit may give the permit to hunt on the owner's
3 3 farm unit to any person who is otherwise licensed, except for
3 4 a deer license, to hunt in this state. If a deer depredation
3 5 permit is used by any person other than the owner of the farm
3 6 unit, the name and address of the user shall be legibly
3 7 written on the permit and on the return postcard.
3 8 Except during a regular shotgun season, any bow and arrow
3 9 or other legal firearm may be used to take deer with a deer
  3 10 depredation permit.
3 11 A person violating the provisions of the bill is guilty of
3 12 a simple misdemeanor which is punishable by a scheduled fine
