PAG LIN 1 1 Section 1. Section 708.2A, subsection 5, paragraph a, Code 1 2 2003, is amended to read as follows: 1 3 5. a. A conviction for, deferred judgment for, or plea of 1 4 guilty to,a violation of this section which occurred prior to 1 5 July 1, 1998,more than six years prior to the date of the1 6violation chargedshall not be considered in determining that 1 7 the violation charged is a second or subsequent offense. 1 8 EXPLANATION 1 9 This bill relates to the charging of second or subsequent 1 10 domestic abuse assault offenses. 1 11 The bill provides that a conviction for, deferred judgment 1 12 for, or plea of guilty to a domestic abuse assault, as defined 1 13 in Code section 708.2A, which occurred prior to July 1, 1998, 1 14 shall not be considered in determining that the violation 1 15 charged is a second or subsequent offense. 1 16 LSB 5956HH 80 1 17 rh/sh/8.1
