  1  1    Section 1.  SUPPLEMENTAL APPROPRIATION.  After applying the
  1  2 reduction made pursuant to executive order number 31 to the
  1  3 appropriation for school aid under section 257.16, there is
  1  4 appropriated from the following designated funds of the state
  1  5 to the department of education for the fiscal year beginning
  1  6 July 1, 2003, and ending June 30, 2004, the following amounts,
  1  7 or so much thereof as is necessary:
  1  8    1.  From the economic emergency fund created in section
  1  9 8.55, notwithstanding any conflicting provisions of section
  1 10 8.55:  
  1 11 .................................................. $  3,300,000
  1 12    2.  From the cash reserve fund created in section 8.56,
  1 13 notwithstanding any conflicting provisions of section 8.56:  
  1 14 .................................................. $ 24,000,000
  1 15    3.  From the general fund of the state:  
  1 16 .................................................. $ 18,140,779
  1 17    Amounts appropriated pursuant to this section shall
  1 18 supplement amounts appropriated pursuant to section 257.16
  1 19 from the general fund of the state to pay the foundation aid
  1 20 and supplementary aid under section 257.4, subsection 2.  The
  1 21 amount received by a school district from the amounts
  1 22 appropriated pursuant to this section shall not be added to
  1 23 the district cost of the school district or be considered
  1 24 miscellaneous income of the school district.
  1 25    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 26 immediate importance, takes effect upon enactment.  
  1 27                           EXPLANATION
  1 28    This bill provides for the restoration of education funding
  1 29 which was reduced as part of a 2.5 percent across-the-board
  1 30 budget reduction ordered pursuant to executive order number
  1 31 31.
  1 32    The bill provides that after applying the reduction made
  1 33 pursuant to the executive order, an appropriation shall be
  1 34 made to the department of education for the fiscal year
  1 35 beginning July 1, 2003, and ending June 30, 2004, in an amount
  2  1 totaling $45,441,079.  The appropriation shall be made to
  2  2 supplement amounts appropriated pursuant to Code section
  2  3 257.16 from the general fund of the state to pay the
  2  4 foundation aid and supplementary aid under Code section 257.4,
  2  5 subsection 2.  The bill provides that amounts received by a
  2  6 school district pursuant to the appropriation shall not be
  2  7 added to the district cost of a school district or considered
  2  8 miscellaneous income, in order that a school district's
  2  9 spending authority, which was not reduced by the across-the-
  2 10 board reduction, shall not be increased by the amount of the
  2 11 supplemental appropriation.
  2 12    The bill makes transfers to the department for the fiscal
  2 13 year beginning July 1, 2003, and ending June 30, 2004, from
  2 14 the economic emergency fund and cash reserve fund in the
  2 15 amounts of $3.3 million and $24 million, respectively, and a
  2 16 transfer from the general fund of the state in the amount of
  2 17 $18,140,779.  The bill provides that the transfers shall be
  2 18 exempt from provisions in Code sections 8.55 and 8.56, which
  2 19 otherwise prohibit transfers from the funds or use of the
  2 20 moneys in the funds by means other than an appropriation.
  2 21    The bill takes effect upon enactment.
