  1  1    Section 1.  Section 257.8, subsection 1, Code Supplement
  1  2 2003, is amended to read as follows:
  1  3    1.  STATE PERCENT OF GROWTH.  The state percent of growth
  1  4 for the budget year beginning July 1, 2003, is two percent.
  1  5 The state percent of growth for the budget year beginning July
  1  6 1, 2004, is two percent.  The state percent of growth for the
  1  7 budget year beginning July 1, 2005, is two percent.  The state
  1  8 percent of growth for the budget year beginning July 1, 2006,
  1  9 and each subsequent budget year shall be established by
  1 10 statute which shall be enacted within thirty days of the
  1 11 submission in the year preceding the base year of the
  1 12 governor's budget under section 8.21.  The establishment of
  1 13 the state percent of growth for a budget year shall be the
  1 14 only subject matter of the bill which enacts the state percent
  1 15 of growth for a budget year.
  1 16    Sec. 2.  Section 257.16, Code 2003, is amended by adding
  1 17 the following new subsection:
  1 18    NEW SUBSECTION.  5.  a.  Notwithstanding subsection 1, the
  1 19 amount appropriated from the general fund of the state for
  1 20 state foundation and supplementary aid for the fiscal period
  1 21 beginning July 1, 2004, and ending June 30, 2006, shall be the
  1 22 following:
  1 23    (1)  For the fiscal year beginning July 1, 2004, the sum of
  1 24 one billion eight hundred eighty-one million six hundred
  1 25 eighty-eight thousand six hundred twenty-eight dollars.  Of
  1 26 the amount appropriated pursuant to this subparagraph, ten
  1 27 million dollars shall be used by school districts to assist
  1 28 with the purchase of public school textbooks and supplies.
  1 29 The amount allocated shall be distributed to school districts
  1 30 on a per pupil basis, and shall be used exclusively for
  1 31 textbook and supply acquisition for public schools.  If any
  1 32 portion of the moneys received by a school district for
  1 33 textbook and supply acquisition remains unexpended at the end
  1 34 of the budget year, the remainder shall be carried over to the
  1 35 subsequent budget year and added to the school district's
  2  1 textbook and supply acquisition budget for that year.
  2  2    (2)  For the fiscal year beginning July 1, 2005, the sum of
  2  3 one billion nine hundred twenty-six million five hundred
  2  4 twelve thousand nine hundred ninety-four dollars.  Of the
  2  5 amount appropriated pursuant to this subparagraph, ten million
  2  6 dollars shall be used by school districts to assist with the
  2  7 purchase of public school textbooks and supplies.  The amount
  2  8 allocated shall be distributed to school districts on a per
  2  9 pupil basis, and shall be used exclusively for textbook and
  2 10 supply acquisition for public schools.  If any portion of the
  2 11 moneys received by a school district for textbook and supply
  2 12 acquisition remains unexpended at the end of the budget year,
  2 13 the remainder shall be carried over to the subsequent budget
  2 14 year and added to the school district's textbook and supply
  2 15 acquisition budget for that year.
  2 16    b.  If the amounts appropriated in this subsection are less
  2 17 than the amounts otherwise required pursuant to subsection 1,
  2 18 the difference shall be deducted from the payments that
  2 19 otherwise would have been required to be made to each school
  2 20 district in the same ratio that the budget enrollment of the
  2 21 school district for the appropriate budget year bears to the
  2 22 total budget enrollment in the state for that budget year.
  2 23    Sec. 3.  Notwithstanding the thirty-day deadline and
  2 24 restrictions for the enactment of the state percent of growth
  2 25 provided in section 257.8, subsection 1, such deadline and
  2 26 restrictions shall not apply to the Act enacted which
  2 27 establishes the state percent of growth during the 2004
  2 28 Regular Session of the Eightieth General Assembly.
  2 29    Sec. 4.  APPLICABILITY.  This Act is applicable for
  2 30 computing state aid under the state school foundation program
  2 31 for the school budget years beginning July 1, 2004, and July
  2 32 1, 2005.  
  2 33                           EXPLANATION
  2 34    This bill establishes a state percent of growth of 2
  2 35 percent for purposes of the state school foundation program
  3  1 for the school budget year beginning July 1, 2005.
  3  2    The bill provides that for the budget year beginning July
  3  3 1, 2006, and each subsequent budget year, the state percent of
  3  4 growth shall be established by statute and enacted within 30
  3  5 days of the submission of the governor's budget under Code
  3  6 section 8.21 in the base year.  Currently, Code section 257.8
  3  7 provides that the enactment shall be within 30 days of the
  3  8 submission of the governor's budget in the year preceding the
  3  9 base year.  The effect of this change would be to establish
  3 10 the state percent of growth during the regular legislative
  3 11 session immediately preceding the start of the July 1 budget
  3 12 year, rather than during the regular legislative session in
  3 13 the previous year.
  3 14    The bill also provides for appropriations for the payment
  3 15 of state foundation aid and supplementary aid.  The bill
  3 16 provides that for the fiscal year beginning July 1, 2004, and
  3 17 ending June 30, 2005, there is appropriated from the general
  3 18 fund of the state pursuant to Code section 257.16 the sum of
  3 19 $1,881,688,628 to pay state foundation aid and supplementary
  3 20 aid, and that for the fiscal year beginning July 1, 2005, and
  3 21 ending June 30, 2006, there is appropriated from the general
  3 22 fund of the state pursuant to Code section 257.16 the sum of
  3 23 $1,926,512,994 to pay state foundation aid and supplementary
  3 24 aid.  The bill provides that of the amount appropriated for
  3 25 the fiscal years beginning July 1, 2004, and July 1, 2005, $10
  3 26 million shall be used by school districts to assist with the
  3 27 purchase of public school textbooks and supplies.  The bill
  3 28 provides that the amount allocated for textbooks and supplies
  3 29 shall be distributed on a per pupil basis, shall be used
  3 30 exclusively for public school textbook and supply acquisition,
  3 31 and that if any portion of the moneys received by a school
  3 32 district for textbook and supply acquisition remains
  3 33 unexpended at the end of the budget year, the remainder shall
  3 34 be carried over to the school district's subsequent budget
  3 35 year and added to the textbook and supply acquisition budget
  4  1 for that year.
  4  2    The bill provides that if the amounts appropriated are less
  4  3 than the amounts otherwise required to pay state foundation
  4  4 aid and supplementary aid pursuant to Code section 257.16,
  4  5 subsection 1, the difference shall be deducted from the
  4  6 payments that otherwise would have been made to each school
  4  7 district in the same ratio that the budget enrollment of the
  4  8 school district for the appropriate budget year bears to the
  4  9 total budget enrollment in the state for that budget year.
  4 10    The bill includes an exemption to the language in Code
  4 11 section 257.8, subsection 1, which states that the
  4 12 establishment of the state percent of growth for a budget year
  4 13 shall be the only subject matter of the bill which enacts it.
  4 14    The bill is applicable for computing state aid under the
  4 15 state school foundation program for the school budget years
  4 16 beginning July 1, 2004, and July 1, 2005.
