  1  1    Section 1.  Section 321.182, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  5.  a.  A noncitizen applicant who
  1  4 presents all of the following documentation shall be deemed to
  1  5 have established proof of identity as required by the
  1  6 department to qualify for licensure:
  1  7    (1)  A valid passport issued by a foreign jurisdiction or
  1  8 an original or certified copy of a government-issued birth
  1  9 certificate from a foreign jurisdiction.
  1 10    (2)  A social security card or a federal taxpayer
  1 11 identification card or certification letter.
  1 12    (3)  A matricula consular identity card.
  1 13    b.  A noncitizen applicant who establishes proof of
  1 14 identity under paragraph "a" and presents a valid driver's
  1 15 license issued by a jurisdiction in another country, or
  1 16 presents evidence of completion of a driver education course
  1 17 approved by the department, is subject to the requirements of
  1 18 section 321.186 at the discretion of the department in the
  1 19 same manner as an applicant who was previously licensed to
  1 20 drive in another state.
  1 21    Sec. 2.  Section 321.190, subsection 1, paragraph a, Code
  1 22 Supplement 2003, is amended to read as follows:
  1 23    a.  The department shall, upon application and payment of
  1 24 the required fee, issue to an applicant a nonoperator's
  1 25 identification card.  To be valid the card shall bear a
  1 26 distinguishing number assigned to the card holder, the full
  1 27 name, date of birth, sex, residence address, a physical
  1 28 description and a colored photograph of the card holder, the
  1 29 usual signature of the card holder, and such other information
  1 30 as the department may require by rule.  An applicant for a
  1 31 nonoperator's identification card shall apply for the card in
  1 32 the manner provided in section 321.182, subsections 1, through
  1 33 2, 3, and 5.  The card shall be issued to the applicant at the
  1 34 time of application pursuant to procedures established by
  1 35 rule.  An applicant for a nonoperator's identification card
  2  1 who is required by 50 U.S.C. app. } 451 et seq.  to register
  2  2 with the United States selective service system shall be
  2  3 registered by the department with the selective service system
  2  4 as provided in section 321.183.  
  2  5                           EXPLANATION
  2  6    This bill amends the application procedures for issuance of
  2  7 a driver's license or nonoperator's identification card to
  2  8 noncitizen applicants.  The state department of transportation
  2  9 is required to accept, as proof of an applicant's identity, a
  2 10 matricula consular identity card accompanied by a valid
  2 11 foreign passport or original or certified copy of a foreign
  2 12 birth certificate and a social security card or federal
  2 13 taxpayer identification card or letter.  In addition, the bill
  2 14 provides that if such an applicant presents a valid driver's
  2 15 license from another country or evidence of completion of an
  2 16 approved driver education course, the department may exercise
  2 17 its discretion to examine or waive examination of the
  2 18 applicant, as it does now for applicants previously licensed
  2 19 to drive in other states.
  2 20    The matricula consular identity card is an official form of
  2 21 identification currently issued only by the Mexican
  2 22 government.
