  1  4 TO ELIMINATE THE INSPECTIONS DIVISION OF THE DEPARTMENT OF
  1  5    INSPECTIONS AND APPEALS.
  1  6  
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8  
  1  9    Section 1.  Section 10A.104, Code Supplement 2003, is
  1 10 amended by adding the following new subsections:
  1 11    NEW SUBSECTION.  12.  Administer inspections and licensing
  1 12 of hotels, home food establishments, and egg handlers.
  1 13    NEW SUBSECTION.  13.  Administer inspections and licensing
  1 14 of food establishments, including but not limited to
  1 15 restaurants, vending machines, food processing plants, grocery
  1 16 stores, convenience stores, temporary food establishments, and
  1 17 mobile food units.
  1 18    NEW SUBSECTION.  14.  Administer inspections for sanitation
  1 19 in any locality of the state upon the written petition of five
  1 20 or more residents of the locality.
  1 21    NEW SUBSECTION.  15.  Administer inspections of cosmetology
  1 22 salons under section 157.7 and barbershops under section
  1 23 158.6.
  1 24    Sec. 2.  Section 10A.106, Code 2003, is amended to read as
  1 25 follows:
  1 26    10A.106  DIVISIONS OF THE DEPARTMENT.
  1 27    The department is comprised of the following divisions:
  1 28    1.  Administrative hearings division.
  1 29    2.  Investigations division.
  1 30    3.  Inspections division.
  1 31    4. 3.  Health facilities division.
  1 32    The allocation of departmental duties to the divisions of
  1 33 the department in sections 10A.402, 10A.502, 10A.702, and
  1 34 10A.801 does not prohibit the director from reallocating
  1 35 departmental duties within the department.
  2  1    Sec. 3.  Section 137C.2, subsection 2, Code 2003, is
  2  2 amended to read as follows:
  2  3    2.  "Director" means the director of the department of
  2  4 inspections and appeals or the chief inspector of the
  2  5 inspections division of the department of inspections and
  2  6 appeals director's designee.
  2  7    Sec. 4.  Sections 10A.501 and 10A.502, Code 2003, are
  2  8 repealed.
