  1  4 RELATING TO MEMBERSHIP ON CERTAIN CITY PLANNING AND ZONING
  1  5    COMMISSIONS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 414.23, unnumbered paragraph 2, Code
  1 10 2003, is amended to read as follows:
  1 11    A municipality, during the time its zoning jurisdiction is
  1 12 extended under this section, shall increase the size of its
  1 13 planning and zoning commission and its board of adjustment
  1 14 each by two members.  The planning and zoning commission shall
  1 15 include a member of the board of supervisors of the affected
  1 16 county, or the board's designee, and a resident of the area
  1 17 outside the city limits over which the zoning jurisdiction is
  1 18 extended.  The board's designee, if any, shall be a resident
  1 19 of the county in which such extended area is located.  The
  1 20 additional members of the board of adjustment shall be
  1 21 residents of the area outside the city limits over which the
  1 22 zoning jurisdiction is extended.  The county supervisor, or
  1 23 the board's designee, and the residents shall be appointed by
  1 24 the board of supervisors of the county in which such extended
  1 25 area is located and.  The county supervisor, or the board's
  1 26 designee, and the residents shall serve for the same terms of
  1 27 office and have the same rights, privileges, and duties as
  1 28 other members of each of the bodies.  However, if the extended
  1 29 zoning jurisdiction of a municipality extends into an adjacent
  1 30 county without a county zoning ordinance, the boards of
  1 31 supervisors of the affected counties, jointly, shall appoint
  1 32 one of their members, or a designee, to the planning and
  1 33 zoning commission.
