PAG LIN 1 1 HOUSE FILE 676 1 2 1 3 AN ACT 1 4 ESTABLISHING A VETERANS TRUST FUND UNDER THE CONTROL OF THE 1 5 COMMISSION OF VETERANS AFFAIRS AND PROVIDING A CONTINGENT 1 6 APPROPRIATION. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. NEW SECTION. 35A.13 VETERANS TRUST FUND. 1 11 1. For the purposes of this section, "veteran" means the 1 12 same as defined in section 35.1 or a resident of this state 1 13 who served in the armed forces of the United States, completed 1 14 a minimum aggregate of ninety days of active federal service, 1 15 and was discharged under honorable conditions. 1 16 2. A veterans trust fund is created in the state treasury 1 17 under the control of the commission. 1 18 3. The trust fund shall consist of all of the following: 1 19 a. Moneys in the form of a devise, gift, bequest, 1 20 donation, federal or other grant, reimbursement, repayment, 1 21 judgment, transfer, payment, or appropriation from any source 1 22 intended to be used for the purposes of the trust fund. 1 23 b. Interest attributable to investment of moneys in the 1 24 fund or an account of the trust fund. Notwithstanding section 1 25 12C.7, subsection 2, interest or earnings on moneys in the 1 26 trust fund shall be credited to the trust fund. 1 27 4. Moneys credited to the trust fund shall not be 1 28 transferred, used, obligated, appropriated, or otherwise 1 29 encumbered, except as provided in this section. Moneys in the 1 30 trust fund may be used for cash flow purposes during a fiscal 1 31 year provided that any moneys so allocated are returned to the 1 32 trust fund by the end of that fiscal year. 1 33 5. The minimum balance of the trust fund required prior to 1 34 expenditure of moneys from the trust fund is fifty million 1 35 dollars. Once the minimum balance is reached, the interest 2 1 and earnings on the fund and any moneys received under 2 2 subsection 3, paragraph "a", are appropriated to the 2 3 commission to be used to achieve the purposes of this section. 2 4 6. Moneys appropriated to the commission under this 2 5 section shall not be used to supplant funding previously 2 6 provided by other sources. The moneys may be expended upon a 2 7 majority vote of the commission membership for the benefit of 2 8 veterans and the spouses and dependents of veterans, for any 2 9 of the following purposes: 2 10 a. College tuition aid. 2 11 b. Job training aid. 2 12 c. Expenses relating to an individual receiving care by a 2 13 nursing facility that are not payable by any other sources. 2 14 d. Benefits provided to children of disabled or deceased 2 15 veterans. 2 16 e. Unemployment aid needed during a veteran's unemployment 2 17 due to prolonged illness or disability resulting from military 2 18 service. A diagnosed case of mental distress due to military 2 19 service-related activities shall be included as a disability 2 20 under this paragraph. 2 21 f.
