PAG LIN 1 1 Section 1. STATE SERVICES REGIONAL BOUNDARIES. 1 2 1. A state services regional boundaries task force, 1 3 hereafter referred to as the task force, is created. The task 1 4 force shall be comprised of eight members selected in the 1 5 following manner: 1 6 a. One member shall be appointed jointly by the 1 7 administrators of the area education agencies created by 1 8 chapter 273. 1 9 b. One member shall be appointed by the director of the 1 10 department of human services. 1 11 c. One member shall be appointed jointly by the directors 1 12 of the judicial district departments of correctional services 1 13 created by chapter 905. 1 14 d. One member shall be appointed by the chief justice of 1 15 the supreme court. 1 16 e. Two citizen members shall be appointed by the governor. 1 17 f. One citizen member shall be appointed jointly by the 1 18 majority leader of the senate and the speaker of the house of 1 19 representatives. 1 20 g. One citizen member shall be appointed jointly by the 1 21 minority leader of the senate and the minority leader of the 1 22 house of representatives. 1 23 2. The task force is charged with the responsibility of 1 24 proposing common boundaries for department of human services 1 25 service areas, judicial districts, and judicial district 1 26 departments of correctional services. The common boundaries 1 27 shall, to the extent practicable, be wholly contained within 1 28 the proposed new area education agency boundaries, including 1 29 the boundaries of area education agencies that have merged or 1 30 are proposed to merge, as recommended, proposed, and submitted 1 31 to the task force by area education agencies by a date 1 32 specified by the task force. No more than eight regions shall 1 33 be proposed by the task force; however, any entity may have 1 34 fewer regions if the larger region boundaries are consistent 1 35 with the smaller coextensive region boundaries. The task 2 1 force shall issue a report to the general assembly's joint 2 2 government oversight committee by October 1, 2003, containing 2 3 its findings and recommended service area boundaries. 2 4 3. If the task force fails to issue a report by October 1, 2 5 2003, or if no common state services regional boundaries 2 6 proposal is contained in its recommendations, the joint 2 7 legislative government oversight committee shall direct the 2 8 legislative service bureau to develop a plan for common 2 9 regional boundaries for submission to the general assembly 2 10 which plan shall be submitted to the general assembly by 2 11 December 31, 2003. The joint government oversight committee 2 12 shall develop the criteria to be followed by the legislative 2 13 service bureau in establishing a common regional boundaries 2 14 plan. The criteria shall provide, at a minimum, that the 2 15 legislative service bureau consider the needs of the entities 2 16 providing state services and identify the boundaries that will 2 17 provide the greatest efficiencies, while maximizing the 2 18 ability to deliver state services with limited financial 2 19 resources. 2 20 4. A plan for common regional boundaries submitted to the 2 21 general assembly pursuant to this section shall provide for 2 22 the establishment of an advisory committee within each new 2 23 region to provide input for the planning and implementation of 2 24 the staffing and operations of the new region. 2 25 Sec. 2. COMMUNITY COLLEGE ADMINISTRATIVE SERVICES. The 2 26 department of education shall investigate the possible 2 27 consolidation of administrative services of community colleges 2 28 located within the boundaries of area education agencies that 2 29 have merged or have been proposed to merge and shall submit a 2 30 written report to the legislative government oversight 2 31 committee by October 1, 2003, of its findings and 2 32 recommendations. 2 33 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 34 immediate importance, takes effect upon enactment. 2 35 EXPLANATION 3 1 This bill relates to government efficiency by providing for 3 2 the establishment of common state services administrative 3 3 boundaries. 3 4 The bill provides for the establishment of a state services 3 5 regional boundaries task force whose charge shall be the 3 6 development of a proposal to create not more than eight common 3 7 regions for department of human services service areas, 3 8 judicial districts, and judicial district departments of 3 9 correctional services. The common regions shall, to the 3 10 extent practicable, be contained within proposed new area 3 11 education agency boundaries in a proposal to be submitted to 3 12 the task force. The task force shall be comprised of a 3 13 representative from the area education agencies, department of 3 14 human services, judicial district departments of correctional 3 15 services, two citizens appointed by the governor, a 3 16 representative appointed by the chief justice, a citizen 3 17 appointed by the majority party leadership of the general 3 18 assembly, and a citizen appointed by the minority party 3 19 leadership of the general assembly. 3 20 The bill provides that the task force shall make 3 21 recommendations to the general assembly for common boundaries 3 22 by October 1, 2003. If the task force fails to make a 3 23 recommendation, the bill provides that the joint legislative 3 24 government oversight committee shall provide criteria upon 3 25 which the legislative service bureau shall design a plan with 3 26 common boundaries to be submitted to the general assembly by 3 27 December 31, 2003. At a minimum, the criteria shall provide 3 28 that the legislative service bureau consider the needs of the 3 29 entities delivering state services and identify the boundaries 3 30 that will provide the greatest efficiencies, while maximizing 3 31 the ability to deliver the services with limited financial 3 32 resources. The bill further provides that any proposal 3 33 submitted to the general assembly shall include a provision 3 34 establishing an advisory committee in each new district to 3 35 provide input for the planning and implementation of the 4 1 staffing and operations of the new district. 4 2 The bill further provides that the department of education 4 3 shall investigate the possible consolidation of administrative 4 4 services of community colleges located within the boundaries 4 5 of area education agencies and submit a written report to the 4 6 government oversight committee of the general assembly by 4 7 October 1, 2003. 4 8 The bill takes effect upon enactment. 4 9 LSB 3364HV 80 4 10 ec/pj/5
