  1  4 CREATING THE CRIME OF INVASION OF PRIVACY, AND PROVIDING A
  1  5    PENALTY.
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  NEW SECTION.  709.19A  INVASION OF PRIVACY –
  1 10 NUDITY.
  1 11    1.  A person who knowingly views, photographs, or films
  1 12 another person, for the purpose of arousing or gratifying the
  1 13 sexual desire of any person, commits invasion of privacy if
  1 14 all of the following apply:
  1 15    a.  The other person does not have knowledge about and does
  1 16 not consent or is unable to consent to being viewed,
  1 17 photographed, or filmed.
  1 18    b.  The other person is in a state of full or partial
  1 19 nudity.
  1 20    c.  The other person has a reasonable expectation of
  1 21 privacy while in a state of full or partial nudity.
  1 22    2.  As used in this section:
  1 23    a.  "Full or partial nudity" means the showing of any part
  1 24 of the human genitals or pubic area or buttocks, or any part
  1 25 of the nipple of the breast of a female, with less than fully
  1 26 opaque covering.
  1 27    b.  "Photographs or films" means the making of any
  1 28 photograph, motion picture film, videotape, or any other
  1 29 recording or transmission of the image of a person.
  1 30    3.  A person who violates this section commits a serious
  1 31 misdemeanor.
