PAG LIN 1 1 Section 1. NEW SECTION. 321G.22A ESTABLISHMENT OF ALL- 1 2 TERRAIN VEHICLE RECREATIONAL RIDING AREA LIMITATION OF 1 3 LIABILITY. 1 4 1. All-terrain vehicle fees collected pursuant to sections 1 5 321G.4 and 321G.6 are appropriated and may be used for the 1 6 establishment, maintenance, and operation of all-terrain 1 7 vehicle recreational riding areas through the awarding of 1 8 grants administered by the department. All-terrain vehicle 1 9 recreational riding areas established, maintained, or operated 1 10 by the use of such grants shall not be operated for profit. 1 11 2. A public or private owner of land on which an all- 1 12 terrain vehicle recreational riding area is established, 1 13 maintained, or operated and the public or private owner of 1 14 property adjoining such land owe no duty of care to keep the 1 15 land and the adjoining land safe for entry or use by persons 1 16 operating an all-terrain vehicle or other recreational 1 17 vehicle, or to give any warning of a dangerous condition, use, 1 18 structure, or activity on such premises to persons entering 1 19 for such purposes. A lessee or other agent of the owner and 1 20 any prior owners of the land and adjoining land shall have no 1 21 greater duty of care than the current owner or current 1 22 adjoining owner. 1 23 EXPLANATION 1 24 This bill relates to the establishment of an all-terrain 1 25 vehicle recreational riding area. 1 26 The bill appropriates and provides that all-terrain vehicle 1 27 fees collected pursuant to Code chapter 321G may be used for 1 28 the establishment and operation of not-for-profit all-terrain 1 29 vehicle recreational riding areas. 1 30 The bill limits the liability of a public or private owner 1 31 of land on which an all-terrain vehicle recreational riding 1 32 area is established. In addition, a lessee or other agent of 1 33 the owner and any prior owners of the land and adjoining land 1 34 shall have no greater duty of care than the current owner or 1 35 current adjoining owner. 2 1 LSB 2752YH 80 2 2 rh/sh/8
