PAG LIN 1 1 Section 1. Section 321G.4, unnumbered paragraphs 1 and 2, 1 2 Code 2003, are amended to read as follows: 1 3 The owner of each all-terrain vehicleor snowmobile1 4 required to be numbered shall register it every two years, and 1 5 the owner of each snowmobile required to be numbered shall 1 6 register it annually, with the county recorder of the county 1 7 in which the owner resides or, if the owner is a nonresident, 1 8 the owner shall register it in the county in which the all- 1 9 terrain vehicle or snowmobile is principally used. The 1 10 commission has supervisory responsibility over the 1 11 registration of all-terrain vehicles and snowmobiles and shall 1 12 provide each county recorder with registration forms and 1 13 certificates and shall allocate identification numbers to each 1 14 county. 1 15 The owner of the all-terrain vehicle or snowmobile shall 1 16 file an application for registration with the appropriate 1 17 county recorder on forms provided by the commission. The 1 18 application shall be completed and signed by the owner of the 1 19 all-terrain vehicle or snowmobile and shall be accompanied by 1 20 a fee of twenty-five dollars for an all-terrain vehicle or 1 21 fifteen dollars for a snowmobile, and a writing fee. An all- 1 22 terrain vehicle or a snowmobile shall not be registered by the 1 23 county recorder until the county recorder is presented with 1 24 receipts, bills of sale, or other satisfactory evidence that 1 25 the sales or use tax has been paid for the purchase of the 1 26 all-terrain vehicle or snowmobile or that the owner is exempt 1 27 from paying the tax. However, an owner of an all-terrain 1 28 vehicle, except an all-terrain vehicle purchased new on or 1 29 after January 1, 1990, may apply for registration without 1 30 proof of sales or use tax paid until one year after January 1, 1 31 1990. An all-terrain vehicle or snowmobile that has an 1 32 expired registration certificate from another state may be 1 33 registered in this state upon proper application, payment of 1 34 all applicable registration and writing fees, and payment of a 1 35 penalty of five dollars for an all-terrain vehicle or two 2 1 dollars and fifty cents for a snowmobile. 2 2 Sec. 2. Section 321G.6, Code 2003, is amended to read as 2 3 follows: 2 4 321G.6 REGISTRATION RENEWAL TRANSFER. 2 5 1. Every all-terrain vehicleor snowmobileregistration 2 6 certificate and number issued expires at midnight December 31, 2 7 and renewals expire every two years thereafter unless sooner 2 8 terminated or discontinued in accordance with this chapter. 2 9 After the first day of September each even-numbered year, an 2 10 unregistered all-terrain vehicleor snowmobile and renewals2 11 may be registered or a registration may be renewed for the 2 12 subsequent biennium beginning January 1. An all-terrain 2 13 vehicleor snowmobileregistered between January 1 and 2 14 September 1 of even-numbered years shall be registered for a 2 15 fee of twelve dollars and fifty cents for the remainder of the 2 16 registration period. 2 17 After the first day of September in even-numbered years an 2 18 unregistered all-terrain vehicleor snowmobilemay be 2 19 registered for the remainder of the current registration 2 20 period and for the subsequent registration period in one 2 21 transaction. The fee shall be five dollars for the remainder 2 22 of the current period, in addition to the registration fee of 2 23 twenty-five dollars foran all-terrain vehicle and twenty-five2 24dollars for a snowmobile forthe subsequent biennium beginning 2 25 January 1, and a writing fee. 2 26 2. Every snowmobile registration certificate and number 2 27 issued expires at midnight December 31, unless sooner 2 28 terminated or discontinued in accordance with this chapter. 2 29 After the first day of September each year, an unregistered 2 30 snowmobile may be registered or a registration may be renewed 2 31 for the subsequent year beginning January 1. A snowmobile 2 32 registered between June 1 and September 1 shall be registered 2 33 for a fee of seven dollars and fifty cents for the remainder 2 34 of the registration period. 2 35 After the first day of September, a snowmobile may be 3 1 registered for the remainder of the current registration 3 2 period and for the subsequent registration period in one 3 3 transaction. The fee shall be two dollars and fifty cents for 3 4 the remainder of the current period, in addition to the 3 5 registration fee of fifteen dollars for the subsequent year 3 6 beginning January 1, and a writing fee. 3 7 3. Registration certificates and numbers for all-terrain 3 8 vehicles and snowmobiles may be renewed upon application of 3 9 the owner in the same manner as provided in securing the 3 10 original registration. The all-terrain vehicle or snowmobile 3 11 registration fee is in lieu of personal property tax for each 3 12 year of the registration. 3 13 4. An expired all-terrain vehicle or snowmobile 3 14 registration may be renewed for the same fee as if the owner 3 15 is securing the original registration plus a penalty of five 3 16 dollars for an all-terrain vehicle or two dollars and fifty 3 17 cents for a snowmobile, and a writing fee. 3 18All all-terrain vehicles used on public land must be3 19registered within six months following January 1, 1990, unless3 20otherwise exempt.3 21 5. When a person, after registering an all-terrain vehicle 3 22 or snowmobile, moves from the address shown on the 3 23 registration certificate, the person shall, within ten days, 3 24 notify the county recorder in writing of the move and the 3 25 person's new address. 3 26 6. Upon the transfer of ownership of an all-terrain 3 27 vehicle or snowmobile, the owner shall complete the form on 3 28 the back of the title, if any, and registration, if any, and 3 29 deliver both to the purchaser or transferee when the all- 3 30 terrain vehicle or snowmobile is delivered. If the all- 3 31 terrain vehicle or snowmobile is not titled, the owner shall 3 32 complete the form on the back of the current registration 3 33 certificate and shall deliver the certificate to the purchaser 3 34 or transferee at the time of delivering the all-terrain 3 35 vehicle or snowmobile. If the all-terrain vehicle or 4 1 snowmobile has not been titled and has not been registered, 4 2 the owner shall deliver an affidavit for an unregistered and 4 3 untitled all-terrain vehicle or snowmobile to the purchaser or 4 4 transferee. The purchaser or transferee shall, within thirty 4 5 days of transfer, file a new application form with the county 4 6 recorder with a fee of one dollar and the writing fee, and a 4 7 transfer of number shall be awarded in the same manner as 4 8 provided in an original registration. If the purchaser or 4 9 transferee does not file a new application form within thirty 4 10 days of transfer, the transfer of number shall be awarded upon 4 11 payment of all applicable fees plus a penalty of five dollars. 4 12 All registrations must be valid for the current 4 13 registration period prior to the transfer of any registration, 4 14 including assignment to a dealer. 4 15 7. Duplicate registrations may be issued upon application 4 16thereforto the county recorder and the payment of the same 4 17 fees collected for the transfer of registrations. 4 18 8. A motorcycle, as defined in section 321.1, subsection 4 19 40, paragraph "a", may be registered as an all-terrain vehicle 4 20 as provided in this section. A motorcycle registered as an 4 21 all-terrain vehicle may participate in all programs 4 22 established for all-terrain vehicles under this chapter except 4 23 for the safety instruction and certification program. 4 24 Sec. 3. Section 321G.7, unnumbered paragraph 1, Code 2003, 4 25 is amended to read as follows: 4 26 Within ten days after the end of each month, a county 4 27 recorder shall remit to the commission the all-terrain vehicle 4 28 and snowmobile fees collected by the recorder during the 4 29 previous month. Before January 10 of odd-numbered years for 4 30 all-terrain vehicles and each year for snowmobiles, a recorder 4 31 shall remit unused license forms from the previousbiennium4 32 registration period to the commission. 4 33 EXPLANATION 4 34 This bill requires annual registration of snowmobiles and 4 35 establishes a $15 fee, plus a writing fee, for the 5 1 registration. Currently, snowmobiles are registered every 5 2 other year upon payment of a $25 fee plus a writing fee. 5 3 The bill amends related Code provisions to correspond to 5 4 the change to annual registration. 5 5 LSB 1442HV 80 5 6 dea/cl/14
