1 1 Section 1. Section 455B.305, Code 2003, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 7. Beginning on the effective date of
1 4 this Act, the director shall not issue a permit for the
1 5 construction of a new sanitary landfill or expansion of an
1 6 existing sanitary landfill unless the permit requires the
1 7 landfill operator to pay to the county in which the landfill
1 8 is located an annual host fee equal to one hundred dollars per
1 9 property owner within one-half mile of the proposed outer
1 10 boundary of the disposal site of the landfill, or one dollar
1 11 per ton of waste disposed of at the landfill, whichever is
1 12 less. The host fee shall be paid to the county in which the
1 13 landfill is located for purposes of providing a host payment
1 14 to each property owner within one-half mile of the proposed
1 15 outer boundary of the disposal site of the landfill. The
1 16 county shall distribute at least fifty percent of the host
1 17 fees received by the county in equal host payments to each
1 18 property owner within one-half mile of the proposed outer
1 19 boundary of the disposal site of the landfill. The county may
1 20 use the remaining moneys collected from the host fees for
1 21 administration, for additional host payments to each property
1 22 owner, for additional host payments to each property owner
1 23 adjacent to or in the line of sight of the landfill, or for
1 24 any other public purpose.
1 25 EXPLANATION
1 26 This bill relates to the payment of host fees by applicants
1 27 for sanitary landfill construction permits.
1 28 The bill provides that, beginning on the effective date of
1 29 the bill, a construction permit for a new sanitary landfill or
1 30 expansion of an existing sanitary landfill shall not be issued
1 31 unless the permit requires the landfill operator to pay to the
1 32 county in which the landfill is located an annual host fee
1 33 equal to $100 per property owner within one-half mile of the
1 34 proposed outer boundary of the disposal site of the landfill,
1 35 or $1 per ton of waste disposed of at the landfill, whichever
2 1 is less. The bill requires the county to distribute at least
2 2 50 percent of the host fees received by the county in equal
2 3 host payments to each property owner within one-half mile of
2 4 the proposed outer boundary of the disposal site of the
2 5 landfill. The bill allows the county to use the remaining
2 6 moneys collected from the host fees for administration, for
2 7 additional host payments to each property owner, for
2 8 additional host payments to each property owner adjacent to or
2 9 in the line of sight of the landfill, or for any other public
2 10 purpose.
