  1  1    Section 1.  Section 260E.2, subsections 9 and 13, Code
  1  2 2003, are amended to read as follows:
  1  3    9.  "Industry" means a any of the following:
  1  4    a.  A business engaged in interstate or intrastate commerce
  1  5 for the purpose of manufacturing, processing, or assembling
  1  6 products, conducting research and development, or providing
  1  7 services in interstate commerce, but excludes retail, health,
  1  8 or professional services, which business pays wages for the
  1  9 jobs for which the new jobs credit from withholding is taken
  1 10 of at least the average county wage or average regional wage,
  1 11 whichever is lower, as compiled annually by the department of
  1 12 economic development for the community economic betterment
  1 13 program.  For purposes of this subsection, the average
  1 14 regional wage shall be compiled based upon the service
  1 15 delivery areas in section 84B.2.
  1 16    b.  A business eligible for benefits under section 15A.9.
  1 17    c.  A business eligible for benefits under section 15E.196.
  1 18    d.  A business eligible for benefits under the new jobs and
  1 19 income program in chapter 15, subchapter II, part 13.
  1 20    "Industry" does not include a business which closes or
  1 21 substantially reduces its operation in one area of the state
  1 22 of Iowa and relocates substantially the same operation in
  1 23 another area of the state of Iowa.  This subsection does not
  1 24 prohibit a business from expanding its operations in another
  1 25 area of the state provided that existing operations of a
  1 26 similar nature are not closed or substantially reduced.
  1 27    13.  "Program costs" means all necessary and incidental
  1 28 costs of providing program services and may include the costs
  1 29 of actual wages and benefits paid to workers receiving
  1 30 classroom or off-site training for the new jobs created
  1 31 through the new jobs credit from withholding.
  1 32    Sec. 2.  Section 260E.2, subsection 14, paragraph e, Code
  1 33 2003, is amended by striking the paragraph.
  1 34    Sec. 3.  Section 260E.3, subsection 3, Code 2003, is
  1 35 amended by striking the subsection.  
  2  1                           EXPLANATION 
  2  2    This bill relates to eligibility, program costs, and
  2  3 program services under the industrial new jobs training Act.
  2  4    The bill limits the type of industry for which new jobs
  2  5 training programs may be established under the industrial new
  2  6 jobs training Act.  The bill defines the term "industry" to
  2  7 mean one of four different types of business, including:
  2  8    1.  A business eligible for benefits under the quality jobs
  2  9 enterprise zone program.
  2 10    2.  A business eligible for benefits under the enterprise
  2 11 zone program.
  2 12    3.  A business eligible for benefits under the new jobs and
  2 13 income program.
  2 14    4.  A business engaged in interstate or intrastate commerce
  2 15 for the purpose of manufacturing, processing, or assembling
  2 16 products, conducting research and development, or providing
  2 17 services in interstate commerce, but excludes retail, health,
  2 18 or professional services, which business pays wages for the
  2 19 jobs for which the new jobs credit from withholding is taken
  2 20 of at least the average county wage or average regional wage,
  2 21 whichever is lower.
  2 22    The bill provides that program costs may include the costs
  2 23 of actual wages and benefits paid to workers receiving
  2 24 classroom or off-site training for new jobs.
  2 25    The bill eliminates provisions allowing on-the-job training
  2 26 to be included as a program service.
