  1  4 PROVIDING FOR MISCELLANEOUS TECHNICAL AND SUBSTANTIVE CHANGES
  1  5    RELATING TO CONTROLLED AND PRECURSOR SUBSTANCES.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 124.204, subsection 3, paragraph u,
  1 10 Code 2003, is amended by striking the paragraph and inserting
  1 11 in lieu thereof the following:
  1 12    u.  Pholcodine.
  1 13    Sec. 2.  Section 124.204, subsection 6, paragraph g, Code
  1 14 2003, is amended to read as follows:
  1 15    g.  Methcathinone, its salts, optical isomers, and salts of
  1 16 optical isomers.  Some other names:  2-(methylamino)-
  1 17 propiophenone; alpha-(methylamino)propiophenone; 2-
  1 18 (methylamino)-1-phenylpropan-1-one; alpha-N-
  1 19 methylaminopropiophenone; monomethylpropion; ephedrone; N-
  1 20 methylcathinone; methylcathinone; AL-464; AL-422; AL-463; and
  1 21 UR1432.
  1 22    Sec. 3.  Section 124.204, subsection 9, paragraph a, Code
  1 23 2003, is amended to read as follows:
  1 24    a.  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide
  1 25 (denzylfentanyl) (benzylfentanyl), its optical isomers, salts
  1 26 and salts of isomers.
  1 27    Sec. 4.  Section 124.206, subsection 2, paragraph d,
  1 28 unnumbered paragraph 1, Code 2003, is amended to read as
  1 29 follows:
  1 30    Coca leaves and any salt, compound, derivative or
  1 31 preparation of coca leaves.  Decocainized coca leaves or
  1 32 extractions which do not contain cocaine or ecgonine are
  1 33 excluded from this paragraph.  The following substances and
  1 34 their salts, isomers, derivatives, and salts of isomers and
  1 35 derivatives, if salts, isomers, derivatives, or salts of
  2  1 isomers and derivatives exist under the specific chemical
  2  2 designation, are included in this paragraph:
  2  3    Sec. 5.  Section 124.206, subsection 4, paragraph a, Code
  2  4 2003, is amended to read as follows:
  2  5    a.  Amphetamine, its salts, optical isomers, and salts of
  2  6 its optical isomers.
  2  7    Sec. 6.  Section 124.208, subsection 5, Code 2003, is
  2  8 amended by striking the subsection and inserting in lieu
  2  9 thereof the following:
  2 10    5.  NARCOTIC DRUGS.  Unless specifically excepted or unless
  2 11 listed in another schedule:
  2 12    a.  Any material, compound, mixture, or preparation
  2 13 containing any of the following narcotic drugs, or their salts
  2 14 calculated as the free anhydrous base or alkaloid, in limited
  2 15 quantities as set forth below:
  2 16    (1)  Not more than one point eight grams of codeine per one
  2 17 hundred milliliters or not more than ninety milligrams per
  2 18 dosage unit, with an equal or greater quantity of an
  2 19 isoquinoline alkaloid of opium.
  2 20    (2)  Not more than one point eight grams of codeine per one
  2 21 hundred milliliters or not more than ninety milligrams per
  2 22 dosage unit, with one or more active, nonnarcotic ingredients
  2 23 in recognized therapeutic amounts.
  2 24    (3)  Not more than three hundred milligrams of
  2 25 dihydrocodeinone (another name:  hydrocodone) per one hundred
  2 26 milliliters or not more than fifteen milligrams per dosage
  2 27 unit, with a fourfold or greater quantity of an isoquinoline
  2 28 alkaloid of opium.
  2 29    (4)  Not more than three hundred milligrams of
  2 30 dihydrocodeinone (another name:  hydrocodone) per one hundred
  2 31 milliliters or not more than fifteen milligrams per dosage
  2 32 unit, with one or more active, nonnarcotic ingredients in
  2 33 recognized therapeutic amounts.
  2 34    (5)  Not more than one point eight grams of dihydrocodeine
  2 35 (another name:  hydrocodone) per one hundred milliliters or
  3  1 not more than ninety milligrams per dosage unit, with one or
  3  2 more active, nonnarcotic ingredients in recognized therapeutic
  3  3 amounts.
  3  4    (6)  Not more than three hundred milligrams of
  3  5 ethylmorphine per one hundred milliliters or not more than
  3  6 fifteen milligrams per dosage unit, with one or more active,
  3  7 nonnarcotic ingredients in recognized therapeutic amounts.
  3  8    (7)  Not more than five hundred milligrams of opium per one
  3  9 hundred milliliters or per one hundred grams or not more than
  3 10 twenty-five milligrams per dosage unit, with one or more
  3 11 active, nonnarcotic ingredients in recognized therapeutic
  3 12 amounts.
  3 13    (8)  Not more than fifty milligrams of morphine per one
  3 14 hundred milliliters or per one hundred grams, with one or more
  3 15 active, nonnarcotic ingredients in recognized therapeutic
  3 16 amounts.
  3 17    b.  Any material, compound, mixture, or preparation
  3 18 containing the narcotic drug buprenorphine, or its salts.
  3 19    Sec. 7.  Section 124.208, subsection 6, unnumbered
  3 20 paragraph 1, Code 2003, is amended to read as follows:
  3 21    Anabolic steroids, except any Any product containing an
  3 22 anabolic steroid which product is expressly intended for
  3 23 administration through implants to cattle or other nonhuman
  3 24 species is excluded from all schedules, unless such steroid is
  3 25 prescribed, dispensed, or distributed for human use.  Anabolic
  3 26 steroids include Unless specifically excepted or unless listed
  3 27 in another schedule, any material, compound, mixture, or
  3 28 preparation containing any quantity of the following
  3 29 substances, including its salts, isomers, and salts of isomers
  3 30 whenever the existence of such salts of isomers is possible
  3 31 within the specific chemical designation, and including any
  3 32 salt, ester, or isomer of the following drugs or substances if
  3 33 that salt, ester, or isomer promotes muscle growth:
  3 34    Sec. 8.  Section 124.212, subsection 3, Code 2003, is
  3 35 amended by striking the subsection.
  4  1    Sec. 9.  Section 124.304, subsection 1, Code 2003, is
  4  2 amended to read as follows:
  4  3    1.  A The board may suspend, revoke, or restrict a
  4  4 registration under section 124.303 to manufacture, distribute,
  4  5 or dispense a controlled substance may be suspended or revoked
  4  6 by the board upon a finding that any of the following apply to
  4  7 the registrant:
  4  8    a.  Has The registrant has furnished false or fraudulent
  4  9 material information in any application filed under this
  4 10 chapter;.
  4 11    b.  Has The registrant has had the registrant's federal
  4 12 registration suspended or revoked to manufacture, distribute,
  4 13 or dispense controlled substances suspended, revoked, or
  4 14 restricted; or.
  4 15    c.  Has The registrant has been convicted of a public
  4 16 offense under any state or federal law relating to any
  4 17 controlled substance.  For the purpose of this section only, a
  4 18 conviction shall include a plea of guilty, a forfeiture of
  4 19 bail or collateral deposited to secure a defendant's
  4 20 appearance in court which forfeiture has not been vacated, or
  4 21 a finding of guilt in a criminal action even though the entry
  4 22 of the judgment or sentence has been withheld and the
  4 23 individual placed on probation.
  4 24    d.  Has The registrant has committed such acts as would
  4 25 render the registrant's registration under section 124.303
  4 26 inconsistent with the public interest as determined under that
  4 27 section.
  4 28    e.  If the registrant is a licensed health care
  4 29 professional, the registrant has had the registrant's
  4 30 professional license revoked or suspended or has been
  4 31 otherwise disciplined in a way that restricts the registrant's
  4 32 authority to handle or prescribe controlled substances.
  4 33    Sec. 10.  Section 124B.2, subsection 1, Code 2003, is
  4 34 amended by adding the following new paragraphs:
  4 35    NEW PARAGRAPH.  x.  Red phosphorus.
  5  1    NEW PARAGRAPH.  y.  White phosphorus (another name:  yellow
  5  2 phosphorus).
  5  3    NEW PARAGRAPH.  z.  Hypophosphorous acid and its salts
  5  4 (including ammonium hypophosphite, calcium hypophosphite, iron
  5  5 hypophosphite, potassium hypophosphite, manganese
  5  6 hypophosphite, magnesium hypophosphite, and sodium
  5  7 hypophosphite).
