  1  1    Section 1.  Section 514I.8, subsection 2, paragraph c, Code
  1  2 2003, is amended to read as follows:
  1  3    c.  Is a member of a family whose income does not exceed
  1  4 two three hundred percent of the federal poverty level, as
  1  5 defined in 42 U.S.C. } 9902(2), including any revision
  1  6 required by such section.
  1  7    Sec. 2.  Section 514I.10, subsection 2, Code 2003, is
  1  8 amended to read as follows:
  1  9    2.  Cost sharing for eligible children whose family income
  1 10 is between one hundred fifty percent and two three hundred
  1 11 percent of the federal poverty level shall include a premium
  1 12 or copayment amount which is at least a minimum amount but
  1 13 which does not exceed five percent of the annual family
  1 14 income.  The amount of the premium or the copayment amount
  1 15 shall be based on family income and size.
  1 16    Sec. 3.  USE OF WAIVERS AND OTHER METHODS TO RECEIVE
  1 17 ADDITIONAL FEDERAL FUNDING.  The director of human services,
  1 18 with the approval of the hawk-i board established in section
  1 19 514I.5, shall seek additional federal funding by requesting
  1 20 waivers or utilizing other methods available under the
  1 21 Medicaid program, state children's health insurance program,
  1 22 or other sources of additional federal funding to cover
  1 23 program costs or program components that are not included in
  1 24 the standard state children's health insurance program.
  1 25    Sec. 4.  STATE PLAN AMENDMENT – STATE CHILDREN'S HEALTH
  1 26 INSURANCE PROGRAM.  The director of human services shall
  1 27 submit a state plan amendment to the centers for Medicare and
  1 28 Medicaid of the United States department of health and human
  1 29 services for approval of the state children's health insurance
  1 30 program plan amendment to increase coverage under the healthy
  1 31 and well kids in Iowa program for eligible children to three
  1 32 hundred percent of the federal poverty level.
  1 33    Sec. 5.  EFFECTIVE DATES.
  1 34    1.  The sections of this Act directing the director of
  1 35 human services to submit a state plan amendment to the centers
  2  1 for Medicare and Medicaid of the United States department of
  2  2 health and human services for approval to increase coverage
  2  3 under the healthy and well kids in Iowa program for children
  2  4 to three hundred percent of the federal poverty level and
  2  5 directing the director of human services to seek additional
  2  6 funding for payment of program costs and payment of program
  2  7 components not currently covered under the state children's
  2  8 health insurance program, being deemed of immediate
  2  9 importance, take effect upon enactment.
  2 10    2.  The sections of this Act amending sections 514I.8 and
  2 11 514I.10 take effect upon receipt by the director of human
  2 12 services of approval of the state plan amendment.  The
  2 13 director of human services shall notify the Code editor upon
  2 14 receipt of approval of the state plan amendment by the centers
  2 15 for Medicare and Medicaid of the United States department of
  2 16 health and human services.  
  2 17                           EXPLANATION
  2 18    This bill provides for increasing coverage for children
  2 19 under the healthy and well kids in Iowa (hawk-i) program to
  2 20 300 percent of the federal poverty level.  The bill directs
  2 21 the director of human services to submit a state plan
  2 22 amendment to the centers for Medicare and Medicaid services of
  2 23 the United States department of health and human services for
  2 24 approval to increase the coverage.  The bill also directs the
  2 25 director of human services to seek waivers or utilize other
  2 26 methods available under the Medicaid program, the state
  2 27 children's health insurance program, or other sources of
  2 28 federal funding to cover program costs or costs of program
  2 29 components that are not currently covered under the state
  2 30 children's health insurance program.
  2 31    The portions of the bill relating to submitting a state
  2 32 plan amendment and seeking waivers or utilizing other methods
  2 33 to receive additional federal funding take effect upon
  2 34 enactment.  The portions of the bill amending Code sections to
  2 35 increase coverage for children under the hawk-i program to 300
  3  1 percent of the federal poverty level take effect upon receipt
  3  2 of federal approval of the state plan amendment.
